HomeMy WebLinkAboutOrdinance 344 Chapter 6 ORDINANCE NO. 344, AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, AMENDING CHAPTER 6, FIRE PREVENTION AND PROTECTION AND EMERGENCY MEDICAL SERVICES BY ADDING SECTION 6-39, TO ARTICLE III; PROVIDING FOR CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City Commission of of the City of Winter Springs, Florida has determined it to be in the best interests of the safety, health and welfare of the citizens of the City of Winter Springs, Florida, to provide for Automatic Fire Sprinkler Systems. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA: SECTION I - That Chapter 6 is hereby amended by adding Section 6-39 to Article III, as follows: Section 6-39. Automatic Fire Sprinkler Systems Automatic sprinkler systems shall be required as follows: (1) Throughout all buildings used for the manufacture, storage or sale of combustible goods or merchandise if: a) Of Type I construction and; 1. The total area of all floors exceeds twelve thousand (12,000) square feet; or 2. More than two (2) stories in height and the total area of all floors exceeds ten thousand (10,000) square feet; or 3. More than three (3) stories in height regardless of floor area. b) Of less than type I construction and; 1. The total area of all floors exceeds eight thou sand (8,000) square feet; or 2. More than one (1) story in height and the total area of all floors exceeds five thousand (5,000) square feet; ( 3. More than two (2) stories in height, regardless of floor area. (2) Throughout every public garage, excluding parking ramps, if: a) Of type I construction and the total floor area exceeds ten thousand (10,000) square feet. b) Of less than type I construction and the total floor area exceeds six thousand (6,000) square feet. (3) Throughout every hotel, motel, condominium, apartment building or dormitory, if: a) Of type I construction and more than three (3) stories in height. b) Of less than type I construction and more than two (2) stories in height. (4) Throughout bowling alleys, restaurants and bars, if the total floor area exceeds six thousand (6,000) square feet. (5) Throughout all buildings occupied or used as places of public assembly, except those with an occupant load of less than one hundred (100) persons. (6) Throughout all business or office buildings if: a) Of type I construction and more than two (2) stories in height, or fourteen thousand (14,000) square feet. b) Of less than type I construction and more than one (1) story in height or ten thousand (10,000) square feet. (7) Throughout all hospitals, nursing homes, adult congregate living facilities, group homes, convalescing facilities or medical clinics, regardless of height or floor area. (8) Throughout all buildings in excess of fifteen thousand (15,000) square feet, regardless of location, area, height or type of construction. (9) Throughout all Group "H" (hazardous) occupancies, except where the application of water might constitute a life hazard or increase the severity of a fire. (10) Throughout all educational buildings when more than one (1) story or ten thousand (10,000) square feet. (11) All sprinkler systems shall be monitored by a central station monitoring company or on premises monitoring station, manned twenty-four (24) hours a day, seven (7) days a week. (12) All sprinkler systems shall be inspected at least annually by a licensed sprinkler contractor and a record of such inspection shall be furnished to the fire department. (13) Should a sprinkler system be required to be shut off for any reason, the fire department shall be notified when it is shut off and when it is restored to service. (14) Special note: As used herein, the type construction shall refer to the definition in the Southern Standard Building Code. SECTION II - All ordinances or parts of ordinances in conflict herewith to the extent of such conflicts are hereby repealed. If any phrase, clause, sentence, paragraph, section or subsection of this ordinance shall be declared unconstitutional or invalid by a court of competent jurisdiction, such unconstitutionality or invalidity, shall not affect the remaining phrases, clauses, sentences, paragraphs, sections or subsections of this ordinance. Persons are advised that if they decide to appeal any decision made at this meeting, they will need a record of the proceedings and for such purpose, they may need to ensure that a verbatim record of the proceedings is made which record "includes the testimony and evidence upon which the appeal is to be based per Section 286.0105 Florida Statutes.
