ORDINANCE NO. 338
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA,
IMPOSING A ONE YEAR MORATORIUM ON THE RECEIPT OF
APPLICATIONS FOR REVIEW OF A SITE PLAN FOR THE
DEVELOPMENT OF LAND UPON WHICH A CONVENIENCE STORE OR
GAS STATION, NOT INCLUDING FULL SERVICE GAS STATIONS,
WILL BE BUILT, OR A SPECIAL EXCEPTION FOR THE CON-
STRUCTION OF SUCH CONVENIENCE STORE AND/OR GAS STATIONS
NOT INCLUDING FULL SERVICE GAS STATIONS; CONFLICTS AND
EFFECTIVE DATE.
WHEREAS, the City Commission is concerned over the number of
applications for convenience stores and gas stations it has been receiving
and needs additional time to formulate a policy in regard to such uses, and
WHEREAS, the City Commission feels that an emergency situation
exists which requires a short moratorium while the City formulates policy in
this regard and
WHEREAS, the City Commission has recognized a need for service
stations or gas stations which can provide mechanical repair services for the
residents of Winter Springs.
NOW, THEREFORE, THE CITY OF WINTER SPRINGS, FLORIDA,
HEREBY ORDAINS:
SECTION I - There shall be imposed a ONE YEAR moratorium on the
receipt by the City of requests for special exceptions or applications for
review of a site plan for the construction of a gas station, not including full
service gas stations, or convenience stores within the City limits of Winter
Springs, Florida.
SECTION II - If any section or portion of this ordinance proves to
be invalid, unlawful or unconstitutional, it shall not be held to invalidate
or impair the validity, force or effect of any other section or portion of a
section or subsection or part of this Ordinance.
SECTION III - That all ordinances or parts of Ordinances in
conflict herewith are hereby repealed.
SECTION IV - This Ordinance shall take effect immediately upon
its final passage and adoption.

NOTICE IS HEREBY GIVEN by the
City CommiSSIon of the City of Winter
Springs, Florida, that said Commission
will hold a Public Hearing on an ordi-
nance entitled as follows:
ORDINANCE NO. 338
AN ORDINANCE OF THE CITY OF
WINTER SPRINGS, FLORIDA, IM-
POSING A ONE YEAR MORATO-
RIUM ON THE RECEIPT OF AP-
PLICATIONS FOR REVIEW OF A
SITE PLAN FOR THE DEVELOP-
MENT OF LAND UPON WHICH A
CONVENIENCE STORE OR GAS
STATION, NOT INCLUDING FULL
SERVICE GAS STATIONS, WILL

This Public Hearing will be held at
7:30 p.m. on Monday, January 27,
1986, or as soon thereafter as possi-
ble in the Commission Chamber, City
Hall, 1126 East S. R. 434, Winter
Springs, FI. 32708. .
Copies of the proposed ordinance are
available in the office of the City .clerk
for inspection. Interested parties may
appear at this hearing and be heard
with respect to this proposed
ordinance.
Persons are advised that if they de-
cide to appeal any decision made at
this meeting, they will need a record
of the proceedings and for such pur-
pose, they may need to ensure that a
verbatim record Of the proceedings is
mad.e which record includes the testi-
mony and evidence upon which the
appeal is to be based per Section
286.0105 Florida Statutes.
