ORDINANCE NO. 323
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA,
IMPOSING A SIX MONTH MORATORIUM ON THE RECEIPT OF
APPLICATIONS FOR REVIEW OF A SITE PLAN FOR THE
DEVELOPMENT OF LAND UPON WHICH A CONVENIENCE STORE OR
GAS STATION, NOT INCLUDING FULL SERVICE GAS STATIONS,
WILL BE BUILT, OR A SPECIAL EXCEPTION FOR THE CON-
STRUCTION OF SUCH CONVENIENCE STORE AND/OR GAS STATIONS
NOT INCLUDING FULL SERVICE GAS STATIONS; CONFLICTS AND
EFFECTIVE DATE.
WHEREAS, the City Commission is concerned over the number
of applications for convenience stores and gas stations it has been receiving
and needs additional time to formulate a policy in regard to such uses, and
WHEREAS, the City Commission feels that an emergency
situation exists which requires a short moratorium while the City formulates
policy in this regard and
WHEREAS, the City Commission has recognized a need for
service stations or gas stations which can provide mechanical repair services
for the residents of Winter Springs.
NOW, THEREFORE, THE CITY OF WINTER SPRINGS, FLORIDA,
HEREBY ORDAINS:
SECTION I - There shall be imposed a six month moratorium
on the receipt by the City of requests for special exceptions or applications
for review of a site plan for the construction of a gas station, not
including full service gas stations, or convenience stores within the City
limits of Winter Springs, Florida.
SECTION II - If any section or portion of this ordinance
proves to be invalid, unlawful or unconstitutional, it shall not be held to
invalidate or impair the validity, force or effect of any other section or
portion of a section or subsection or part of this Ordinance.
SECTION III - That all ordinances or parts of Ordinances in
conflict herewith are hereby repealed.
SECTION IV - This Ordinance shall take effect immediately
upon its final passage and adoption.
Passed and adopted this 12th day of August ,1985.

OF THE CITY OF WINTER SPRINGS, FLORIDA, THAT:

full service gas stations, or convenience stores within the City limits of
Winter Springs, Florida.
SECTION II - This moratorium shall be effective upon passage of this
resolution.

CITY OF WINTER SPRINGS, FLORIDA
NOTICE IS HEREBY GIVEN by the City Commission of the City of Winter Springs,
Florida, that said Commission will hold a Public Hearing on an ordinance
entitled as follows:
AN ORDINANCE OF THE CITY OF WINTER SPRINGS,
FLORIDA, IMPOSING A SIX MONTH MORATORIUM ON
THE RECEIPT OF APPLICATIONS FOR REVIEW OF A
SITE PLAN FOR THE DEVELOPMENT OF LAND UPON
WHICH A CONVENIENCE STORE OR GAS STATION, NOT
INCLUDING FULL SERVICE GAS STATIONS, WILL BE
BUILT, OR A SPECIAL EXCEPTION FOR THE CON-
STRUCTION OF SUCH CONVENIENCE STORE AND/OR GAS
STATIONS NOT INCLUDING FULL SERVICE GAS STATIONS;
CONFLICTS AND EFFECTIVE DATE.
This Public Hearing will be held at 7:30 p. m. on August 12, 1985
, or as soon thereafter as possible in the Commission Chamber,
City Hall, 400 N. Edgemon Ave., Winter Springs, Florida.
Copies of the proposed ordinance are available in the office of the City
Clerk for inspection. Interested parties may appear at this hearing and be
heard with respect to this proposed ordinance.
Persons are advised that if they decide to appeal any decision made at this
meeting, they will need a record of the proceedings and for such purpose,
they may need to ensure that a verbatim record of the proceedings is made
which record includes the testimony and evidence upon which the appeal is
to be based per Section 286.0105 Florida Statutes.
