ORDINANCE NO. 285
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA,
AMENDING THE PRESENT CODE SECTION 9-14 TO EXPAND
PROHIBITION OF NOISE NUISANCES; PROVIDING FOR
SEVERABILITY, CONFLICTS AND EFFECTIVE DATE.
WHEREAS, the City Commission of Winter Springs, Florida, has
determined that the present ordinance regulating noise nuisances is in-
adequate to assure the peaceful habitation of all citizens in public
places and on private property, and
WHEREAS, the City wishes to provide greater protection for its
residents and property owners against the inconsideration of those who
create any noises which are detrimental to the public cumulatively and
singly.
NOW, THEREFORE, THE CITY COMMISSION OF WINTER SPRINGS,
FLORIDA, HEREBY ORDAINS:
SECTION I - Section 9-14 of the Code of Ordinances of the City of
Winter Springs, Florida, is hereby amended to read as follows:
Section 9-14. NOISE NUISANCES
(a) Prohibited generally. It shall be unlawful for any person to
make, create, or maintain any unreasonably loud, disturbing, and unnecessary
noise within the City. Noise of such character, intensity, or duration as to
be detrimental to the life, health, comfort, or repose of any individual is
prohibited.
(b) Public Places.
(1) Disorderly conduct. Any person endangering or disturbing
the public peace or violating public decency by using any
abusive, obscene, or profane language, or making any
threats of violence to or against any other person, or by
being noisy and disorderly in or upon any street or other
public place in disturbance of the public tranquility
shall, upon conviction, be punished as provided in
Section 1-8.
(2) Noises near schools, churches, hospitals, etc. It shall
be unlawful to make, create, or maintain any excessive
noise on any street adjacent to any school, church, insti-
tution of learning, or court while the same are in session,
or adjacent to any hospital when such noise unreasonably
disturbs the usual quiet prevailing at such institution;
provided, that conspicuous signs are displayed in such
streets indicating that the same is adjacent to a school,
church, hospital, or court.
(3) Peddlers, hawkers, or vendors. It shall be unlawful for
peddlers, hawkers, or vendors to shout or cry along or
on the street to the disturbance of peace or quiet of
the neighborhood.
(4) Drums, loud speakers, etc. It shall be unlawful to create,
make, or maintain any noise by the use of any drum, loud
speaker, or other instrument or device in the City for the
purpose of attracting attention to any performance, show,
sale, or display of merchandise or place of business, except
under a specific license certificate from the Chief of Police.
(5) Mechanical loudspeakers or amplifiers. It shall be un-
lawful to use any mechanical loud speakers or amplifiers
on trucks or other moving vehicles or outside of a build-
ing for advertising or other purposes, except under a
specific license certificate from the Chief of Police.
(6) Gongs or sirens on vehicles. It shall be unlawful for any
person to carry or use upon any vehicle any gong or siren
whistle similar to that used on ambulances or vehicles of
the Police and Fire Departments.
(c) Private Property.
(1) Playing radios, phonographs, etc. It shall be unlawful to
play any radio, phonograph, or any musical instrument or
operate a sound-amplifying device within the City in such
a manner or with such volume, especially during the hours
between 10:00 p.m. and 7:00 a.m., as to annoy or disturb
the quiet, comfort, or repose of persons in any dwelling,
hotel, or other type of residence.
(2) Animals and birds. It shall be unlawful to keep any
animal or bird within the City which by causing frequent
or long continued noise shall disturb the comfort and
repose of any person in the vicinity.
SECTION II - All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION III - If any section or portion of a section or sub-
section of this ordinance proves to be invalid, unlawful or unconstitutional
it shall not be held to invalidate or impair the validity, force or effect
of any other section or portion of a section or sub-section or part of this
ordinance.
SECTION IV - This ordinance shall take effect upon final passage
and adoption.

Chamber, City Hall, 400 N. Edgemon Ave., Winter Springs, Florida.
Copies of the proposed ordinance are available in the office of the City
Clerk for inspection. Interested parties may appear at this hearing and be
heard with respect to this proposed ordinance.
