FL ORDINANCE NO. 282 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, TO EXTEND ITS TERRITORIAL AND MUNICIPAL LIMITS TO ANNEX THE HEREINAFTER DESCRIBED LANDS SITUATE AND BEING IN SEMINOLE COUNTY, FLORIDA, PURSUANT TO FLORIDA STATUTES 171.044; PROVIDING FOR LAND USE CLASSIFICATION AND ZONING OF THE SUBJECT PROPERTY; PROVIDING FOR THE AMENDMENT OF THE OFFICIAL ZONING MAP AND THE CITY'S COMPREHENSIVE LAND USE PLAN; PROVIDING DIRECTIONS TO THE CITY CLERK; SEVERABILITY; CONFLICTS; AND EFFECTIVE DATE. WHEREAS, Winter Springs Development Corporation has petitioned the City Commission of the City of Winter Springs, Florida, to annex the properties described as follows, as owners thereof: Commencing at a post on the section line between Section 8 and Section 9 of Township 21 South, Range 31 East,Seminole Co., at a point 12 chains and 13 links south from the Northeast corner of said Section 8 and running thence south on said section line 16 chains and 55 links to a post, thence west 6 chains and 16 links to a post, thence north 50 east 18 chains and 15 links to a post thence south 810 and 45 minutes east to place of commencement, containing 10 acres and being a portion of the E. 1/2 of the N.E. 1/4 of said Section 8, Township 21 South, Range 31 East. WHEREAS, the Charter of the City of Winter Springs provides for the annexation of property into the corporate limits when enacted by an ordinance of the City, and pursuant to a petition of the landowners; and WHEREAS, Florida Statute 171.044 of the General Laws of Florida provides that a municipal corporation may annex property into its corporate limits, upon the voluntary petition of the owners, by passing and adopting a nonemergency ordinance to annex said property; and WHEREAS, the City Commission of the City of Winter Springs, Florida, is desirous of annexing and redefining the boundaries of the municipality to include the subject property pursuant to the authority contained in the City Charter of the City of Winter Springs, Florida, and Florida Statute 171.044, General Laws of Florida. NOW, THEREFORE, THE CITY OF WINTER SPRINGS, FLORIDA, HEREBY ORDAINS: SECTION I - That the City of Winter Springs, Florida, does herewith and does hereby annex and redefine the boundary lines of the municipality of the City of Winter Springs, Florida, by including those certain contiguous lands lying in Seminole County, Florida, and more particularly described as follows: THIS INSTRUMENT WAS PREPAREDY BY: MARY T. Commencing at a post on the section line between Section and Section 9 of Township 21 South, Range 31 East, Seminole County, at a point 12 chains and 13 links south from the Northeast corner of said Section 8 and running thence south on said section line 16 chains and 55 links to a post, thence west 6 chains and 16 links to a post, thence north 50 east 18 chains and 15 links to a post thence south 810 and 45 minutes east to place of commencement, containing 10 acres and being a portion of the E. 1/2 of the N.E. 1/4 of said Section 8, Township 21 South, Range 31 East. SECTION II - That the City has determined, in anticipation of Seminole County concurrence, that a land use classification of Planned Unit Development and a zoning category of PUD with the designation Single Family should be designated for all the herein annexed properties. SECTION III - That the Comprehensive Plan and Adopted Land Use Map and Official Zoning Map of the City of Winter Springs, Florida, are hereby amended to include the annexed properties in the hereinabove designated land use classification and zoning category. SECTION IV - That upon passage and adoption of this ordinance the City Clerk is hereby directed to file a certified copy of this ordinance with the Clerk of the Circuit Court in and for Seminole County, Florida, and to file a certified copy with the Department of State of the State of Florida. SECTION V - That if any section or portion of a section or sub- section of this ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other section or portion of a section or subsection or part of this ordinance. SECTION VI - That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION VII - That this ordinance shall take effect immediately upon its final passage and adoption.
