ORDINANCE NO. 274
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA,
TO EXTEND ITS TERRITORIAL AND MUNICIPAL LIMITS TO
ANNEX THE HEREINAFTER DESCRIBED LANDS SITUATE AND
BEING IN SEMINOLE COUNTY, FLORIDA, PURSUANT TO FLORIDA;:"
STATUTES 171.044; PROVIDING FOR LAND USE CLASSIFICATION-
AND ZONING OF THE SUBJECT PROPERTY; PROVIDING FOR THE
AMENDMENT OF THE OFFICIAL ZONING MAP AND THE CITY'S
COMPREHENSIVE LAND USE PLAN; PROVIDING DIRECTIONS TO THE
CITY CLERK; SEVERABILITY; CONFLICTS; AND EFFECTIVE DATE.
WHEREAS, The Leffler Company, Cottle and Peters, Inc.,
Edward H., Robert E., and Richard H. Parker, Southern Bell Telephone and
Telegraph Company, Mohican Valley, Inc., and Madeleine M. Luttrell have
petitioned the City Commission of the City of Winter Springs, Florida, to
annex the properties described as follows, as owners thereof:
Lots 4, 5, 6, and 7, Block C; Lots 1 and 2, the West 1/2 of Lot
4, Lots 5, 6, 7, lS, 19, 20, 21, 22, and 23, Block D, D.R.
Mitchell's Survey of the Levy Grant, Plat Book 1, Page 5;
Part of Lot 1, Joe E. Johnston's Survey, Deed Book 147, Page
221, more particularly described as: Beginning NW corner of
Lot 1, run S 22 o15'E 463 feet, N 51o15' E 291.3 feet, N 3So
45' W 200 feet, N 77o45' W to beginning; and
Lots 1 through 26, Luttrell Park, Plat Book 11, Page 44;
All of the preceding of the Public Records of Seminole County,
Florida; and
WHEREAS, the Charter of the City of Winter Springs provides for
the annexation of property into the corporate limits when enacted by an
ordinance of the City, and pursuant to a petition of the landowners; and
WHEREAS, Florida Statute 171.044 of the General Laws of Florida
provides that a municipal corporation may annex property into its corporate
limits, upon the voluntary petition of the owners, by passing and adopting a
nonemergency ordinance to annex said property; and
WHEREAS, the City Commission of the City of Winter Springs, Florida,
is desirous of annexing and redefining the boundaries of the municipality to
include the subject property pursuant to the authority contained in the City
Charter of the City of Winter Springs, Florida, and Florida Statute 171.044,
General Laws of Florida.
NOW, THEREFORE, THE CITY OF WINTER SPRINGS, FLORIDA,
HEREBY ORDAINS:
SECTION I - That the City of Winter Springs, Florida, does herewith
and does hereby annex and redefine the boundary lines of the municipality of
the City of Winter Springs, Florida, by including those certain contiguous

lands lying in Seminole County, Florida, and more particularly described as
follows:
Lots 4, 5, 6, and 7, Block C; Lots 1 and 2, the West 1/2 of Lot
4, Lots 5, 6, 7, 18, 19, 20, 21, 22, and 23, Block D, D.R.
Mitchell's Survey of the Levy Grant, Plat Book 1, Page 5;
Part of Lot 1, Joe E. Johnston's Survey, Deed Book 147, Page
221, more particularly described as: Beginning NW corner of
Lot 1, run S 22015' E 463 feet, N 51015' E 291.3 feet, N 380
45' W 200 feet, N 77045' W to beginning; and
Lots 1 through 26, Luttrell Park, Plat Book 11, Page 44;
All of the preceding of the Public Records of Seminole County,
Florida; and
SECTION II - That the City has determined that a land use classifica-
tion of Rural Residential and a zoning category of R-U (Rural Urban) should be
designated for all the herein annexed properties.
SECTION III - That the Comprehensive Plan and Adopted Land Use Map
and Official Zoning Map of the City of Winter Springs, Florida, are hereby amended
to include the annexed properties in the hereinabove designated land use classifica-
tion and zoning category.
SECTION IV - That upon passage and adoption of this ordinance the
City Clerk is hereby directed to file a certified copy of this ordinance with
the Clerk of the Circuit Court in and for Seminole County, Florida, and to file a
certified copy with the Department of State of the State of Florida.
SECTION V - That if any section or portion of a section or sub-
section of this ordinance proves to be invalid, unlawful, or unconstitutional,
it shall not be held to invalidate or impair the validity, force, or effect of
any other section or portion of a section or subsection or part of this
ordinance.
SECTION VI - That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION VII - That this ordinance shall take effect immediately
upon its final passage and adoption.
