ORDINANCE NO. 273
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA,
ADOPTING AND APPROVING A MONEY PURCHASE PENSION PLAN
AND TRUST FOR THE EMPLOYEES OF THE CITY; PROVIDING
FOR THE COST OF SUCH PLAN TO BE PAID BY THE CITY;
CREATING A BOARD OF TRUSTEES TO ADMINISTER SAID PLAN;
AUTHORIZING THE EXECUTION OF AGREEI1ENT BETWEEN THE CITY
OF WINTER SPRINGS AND SAID BOARD OF TRUSTEES APPOINTED;
PROVIDING FOR CONFLICTS AND EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Winter Springs,
Florida, has determined it to be in the best interest of the City to
provide a money purchase pension plan and trust for the City's employees
and officials; and
WHEREAS, such plan is to be funded exclusively by the City;
and
WHEREAS, to implement the plan, the City will enter into an
agreement with a Board of Trustees who shall be appointed by the City to
administer the plan.
NOW, THEREFORE, THE CITY OF WINTER SPRINGS, FLORIDA,
HEREBY ORDAINS:
SECTION I - The City of Winter Springs does hereby elect to
provide for its employees a money purchase pension plan and trust, said
plan and trust to be known as the "Pension Plan for the Employees of the
City of Winter Springs, Florida" (the "Plan"). The Plan shall be admin-
istered by a Board of Trustees as hereinafter appointed.
SECTION II - The City of Winter Springs does hereby approve and
adopt the Plan, a copy of which is attached hereto, and authorizes the
Mayor and City Manager of the City to execute the Plan on behalf of the City.
The Plan may be amended from time to time by resolution of the City Commission.
SECTION III - The cost of the Plan shall be paid entirely by the
City from the General Fund.
SECTION IV - There is hereby created and established a Board of
Trustees consisting of four (4) members, to wit: MAYOR JOHN V .TORCASO
CITY MANAGER RICHARD ROZANSKY
, COMMISSIONER INEZ LINVILLE and MR. JOHN HATFIELD
, each for a term of three (3) years. The
successors of the original appointees shall likewise be appointed for a term
of three (3) years by resolution of the City Commission. Vacancies in the Board
shall be filled by the City Commission for the unexpired term of such vacancies.
The Board of Trustees herein appointed is hereby authorized to enter into the
Plan with the City of Winter Springs, Florida. The Board of Trustees shall
shall administer the Plan pursuant to the provisions contained therein.
SECTION V - The City of Winter Springs shall be bound by the
terms and conditions of the Plan.
SECTION VI - All ordinances or parts of ordinances in conflict
herewith be and the same hereby are repealed.
SECTION VII - This ordinance shall become effective immediately
upon its final passage and adoption.

Florida, that said Commission will hold a public hearing on an ordinance
entitled as follows:

AND TRUST FOR THE EMPLOYEES ANB OFFIGERS OF THE CITY;
PROVIDING FOR THE COST OF SUCH PLAN TO BE PAID BY THE
CITY; CREATING A BOARD OF TRUSTEES TO ADMINISTER SAID
PLAN; AUTHORIZING THE EXECUTION OF AGREEMENT BETWEEN
THE CITY OF WINTER SPRINGS AND SAID BOARD OF TRUSTEES
APPOINTED; PROVIDING FOR CONFLICTS AND EFFECTIVE DATE.
This Public Hearing will be held at 7:30 p. m. on Tuesday, February 22,
1983 , or as soon thereafter as possible in the Commission
Chamber, City Hall, 400 N. Edgemon Ave., Winter Springs, Florida.
Copies of the proposed ordinance are available in the office of the City
Clerk for inspection. Interested parties may appear at this hearing and be
heard with respect to this proposed ordinance.
Please be advised that, under State Law, if you decide to appeal a decision
made with respect to this matter, you will need a record of the proceedings
and may need to ensure that a verbatim record is made.
