ORDINANCE NO. 267
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA,
ADOPTING THE 1982 EVALUATION AND APPRAISAL REPORT
ON THE CITY'S COMPREHENSIVE PLAN, PURSUANT TO FLORIDA
STATUTES CHAPTER 163; CONFLICTS; SEVERABILITY; AND
EFFECTIVE DATE.
WHEREAS, the Local Government Comprehensive Planning Act of 1975
requires that at five-year intervals after the adoption of a comprehensive
plan, the land planning agency of a local government shall prepare an
assessment of the success of the plan and shall propose amendments to
assure the applicability of the plan to current conditions; and
WHEREAS, the Planning and Zoning Board, acting as the Land Plarming
Agency of the City of Winter Springs, has thoroughly reviewed the existing
plan adopted in 1977 and has caused to be prepared the 1982 Evaluation and
Appraisal Report on the Comprehensive Plan of the City of Winter Springs;
and
'WHEREAS, the 1982 Report has been prepared in accordance with
Florida Statute 163.3191, and has been reviewed by the governing body of
the City and by other jurisdictions as required and has been presented to
the citizenry for their inspection and their comment at public hearings; and
'WHEREAS, the Report in its final form includes amendments to the
Comprehensive Plan which represent the consensus of the government and
the people with respect to goals, policies, and objectives deemed necessary
to be added to those set forth in 1977 so that the Plan in 1982 and for the
subsequent five years will guide and direct the growth of the City in the
best interests of the protection of its human, environmental, social, and
economic resources and of the preservation and enhancement of its desired
character and of the resolution of the challenges it faces.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF WINTER SPRINGS, FLORIDA, THAT:
SECTION I - The 1982 Evaluation and Appraisal Report on the Compre-
hensive Plan of the City of Winter Springs, attached hereto and made a part
hereof by reference, is hereby adopted and incorporated into the Compre-
hensive Plan of the City adopted in 1977.
SECTION II - No public or private development shall be pennitted in
the City except in conformity with the Comprehensive Plan as hereby amended.
SECTION III - Conflicts.
All ordinances or parts of ordinances in conflict herewith are
hereby repealed.
SECTION IV - Severability.
If any section, part of a section, paragraph, sentence, clause,
phrase or work of the Ordinance is, for any reason, held or declared to
be unconstitutional, inoperative, or void, such holding of invalidity shall
not affect the remaining portions of this ordinance and it shall be construed
to have been the legislative intent to pass this Ordinance without such uncon-
stitutional, invalid or inoperative part therein, and the remainder of this
Ordinance, after the exclusion of such part or parts, shall be deemed to be
held valid, and if this Ordinance, or any provisions thereof, shall be held
inapplicable to any person, group of persons, property, kind of property,
circumstances, or set of circumstances, such holding shall not affect the
application hereof to any other person, property or circumstances.
SECTION V - Effective Date.
This Ordinance shall take effect :immediately upon passage and
adoption.
