ORDINANCE NO. 253
AN ORDINANCE OF THE CITY OF WINTER SPRINGS,
FLORIDA ASSESSING IN CRIMINAL PROCEEDINGS,
IN ADDITION TO ALL OTHER COSTS, AN ADDITION-
AL $1.00 TO BE USED FOR LAW ENFORCEMENT
EDUCATION AND TRAINING: PROVIDING FOR SEVER-
ABILITY, CONFLICTS AND AN EFFECTIVE DATE.
WHEREAS, the legislature of the State of Florida has
granted the authority by Section 943.25(5) Florida Statutes to
local government to collect an additional one ($1.00) dollar in
court costs from every person convicted of a violation of a
state penal or criminal statute or convicted of violation of a
municipal ordinance other than parking violations; and has
legislated that one ($1.00) dollar shall be deducted from every
bond estreature and forfeiture related to such penal statute or
ordinance; and
WHEREAS, the legislature of the State of Florida has
mandated that said funds be allocated for the training and
education of law enforcement personnel; and
WHEREAS, the City Council of the City of Winter Springs,
Florida has determined that it would be in the best interests of
the citizens of the City to have the use of said funds for train-
ing and education of law enforcement personnel;
NOW, THEREFORE, THE CITY OF WINTER SPRINGS, FLORIDA,
HEREBY ORDAINS:
SECTION I. There is hereby assessed by the City of
Winter Springs in compliance with section 943.25(5), Florida
Statutes, an additional one and no/lOO ($1.00) dollar, as court
costs against every person convicted for violation of a state
penal or criminal statute or convicted of a municipal or county
ordinance, where said offense occurred within the city limits of
Winter Springs. In addition, one and no/lOO ($1.00) dollar shall
be deducted from every bond estreature or forfeited bail bond
related to such penal statutes or ordinances. However, no such
assessment shall be made against any person convicted for viola-
tion of any state statute, municipal or county ordinance relating
to the parking of vehicles.

All such assessments shall be collected by the appro-
priate court and shall be remitted to the City of Winter Springs,
and earmarked for law enforcement education and training for
members of the police department. The use and expenditure of
such funds shall be in accordance with education and training
programs for law enforcement personnel as determined by the chief
of police and in accordance with section 943.14(4), Florida
Statutes.
SECTION II. Severability.
If any section, subsection, sentence, clause, phrase,
or provision of this ordinance is held to be invalid or unconsti-
tutiona1, such invalidation or unconstitutionality shall not be
construed as to render invalid or unconstitutional the remaining
provisions of this ordinance.
SECTION III. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
SECTION IV. This Ordinance shall take effect immediate-
ly upon its final passage and adoption.

NOTICE OF PUBLIC HEARING
You are hereby informed that the City Council of the City of Winter
Springs, Florida, will hold a public hearing on an ordinance entitled
as follows:
AN ORDINANCE OF THE CITY OF WINrER SPRINGS, FLORIDA,
ASSESSING IN CRIMINAL PROCEEDINGS, IN ADDITION TO ALL
OTHER COSTS, AN ADDITIONAL $1.00 TO BE USED FOR LAW
ENFORCEMENT EDUCATION AND TRAINING; PROVIDING FOR
SEVERABILITY, CONFLICTS AND AN EFFECTIVE DATE.
This Public Hearing will be held at 7:30 p. m. or as soon thereafter as
possible on TUAsday, September 22. 1981 in the Council Chamber,
City Hall, 400 N. Edgemon Ave., Winter Springs, Florida.
Copies of the proposed ordinance are available in the office of the
City Clerk for inspection. Interested parties .may appear at this hearing
and be heard with respect to this proposed ordinance.
Please be advised that, under State Law, if you decide to appeal a
decision made with respect to this matter, you will need a record of
the proceedings and may need to ensure that a verbatim record is made.
