ORDINANCE NO. 246
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA,
REQUIRING MANDATORY CONSERVATION MEASURES IN ACCORD-
ANCE WITH THE DECLARATION OF WATER SHORTAGE WITHIN
THE ST. JOHN'S RIVER WATER MANAGEMENT DISTRICT WITH
MANDATORY WATER CONSERVATION MEASURES; TERMINATION;
CONFLICTS; SEVERABILITY; AND EFFECTIVE DATE.
WHEREAS, the governing body of the St. John's River Water
Management District has declared mandatory water conservation mea-
sures; and
WHEREAS, the governing body has requested the City of
Winter Springs to assist in the conservation effort; and
WHEREAS, the City Council of the City of Winter Springs
is desirous of cooperating with the St. John's River Water Manage-
ment District; and
WHEREAS, the City Council of the City of Winter Springs
finds it to be in the best interest of the public health, safety
and general welfare that water conservation measures be made man-
datory within the City of Winter Springs.
NOW, THEREFORE, THE CITY OF WINTER SPRINGS, HEREBY ORDAINS:
SECTION 1 - That the following mandatory water conservation
measures shall be required:
1. All irrigators within the City of Winter Springs shall
take the following water conservation measures:
A. For those utilizing water for irrigation in the
growing of ferns or, ornamentals, flowers, foliage, and turf grass
(including cemeteries and golf courses), the following water con-
servation practices shall be required immediately.
(1) Irrigation is prohibited during the hours
between 12:00 Noon and 6:00 P.M.
B. For those utilizing water for irrigation in the
growing of citrus, fruit corps, improved pasture, lawns, and row
crops, the following water conservation practices shall be required
immediately.
(I) Irrigation using fixed irrigation systems is
prohibited between the hours of 9:00 A.M. and
6:00 P.M.
(2) For those individuals utilizing seepage, crown
flood, and portable-type irrigation systems, the
time interval between irrigation cycles shall be
extended to the maximum time interval possible
given rainfall and crop conditions.
(3) Irrigation of lawns shall be prohibited between
the hours of 9:00 A.M. and 6:00 P.M. unless by
heat pump air conditioning units.
(4) Irrigation with the use of sewage effluent shall
be exempt from the provisions of this section.
SECTION II - Termination. This ordinance shall hereby
terminate when the governing board of the St. John's River Water
Management District declares the water shortage, declared on July 8,
1981, to be at an end or otherwise removes the mandatory water con-
servation measures imposed for the St. John's River Management Dis-
trict.
SECTION III - Severability. If any section, subsection,
sentence, clause, phrase, or provision of this ordinance is held
to be invalid or unconstitutional, such invalidation or unconsti-
tutionality shall not be construed as to render invalid or uncon-
stitutional the remaining provisions of this ordinance.
SECTION IV - All Ordinances or parts of Ordinances in con-
flict herewith are hereby repealed.
SECTION V - This Ordinance shall take effect immediately
upon its final passage and adoption.

You are hereby informed that the City Council of the City of Winter
Springs, Florida, will hold a public hearing on an ordinance entitled
as follows:
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA,
REQUIRING MANDATORY CONSERVATION MEASURES IN ACCORDANCE
\HTH THE DECLARATION OF WATER SHORTAGE HITHIN THE ST.
JOHN'S RIVER WATER MANAGEMENT DISTRICT HITH MANDATORY
WATER CONSERVATION MEASURES; CONFLICTS; SEVERABILITIES;
AND EFFECTIVE DATE.
This Public Hearing will be held at 7:30 p. m. or as soon thereafter as
possible on September 8, 1981 in the Council Chamber,
City Hall, 400 N. Edgemon Ave., Hinter Springs, Florida.
Copies of the proposed ordinance are available in the office of the
City Clerk for inspection. Interested parties may appear at this hearing
and be heard with respect to this proposed ordinance.
Please be advised that, under State Law, if you decide to appeal a
decision made with respect to this matter, you will need a record of
the proceedings and may need to ensure that a verbatim record is made.
