HomeMy WebLinkAboutOrdinance 244 Alcoholic Beverages PH 14 July ORDINANCE NO. 244 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, AMENDING SECTION 3-5 OF THE CODE OF ORDINANCES OF THE CITY OF WINTER SPRINGS, FLORIDA; ESTABLISHING HOURS FOR THE CONSUMP- TION OF ALCOHOLIC BEVERAGES IN PLACES OF PUBLIC ACCOMODATION; PROVIDING FOR SEVER- ABILITY, CONFLICTS AND AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Winter Springs, Florida has determined that alcoholic beverages are being consumed in places of public accomodation between the hours of 2:00 a.m. and 7:00 a.m. of the same day. WHEREAS, the City Council of the City of Winter Springs, Florida has determined that it is in the interest of the City's public health, peace, safety and welfare to enact an ordinance prohibiting the consumption of alcoholic beverages in places of public accomodation between the hours of 2:00 a.m. and 7:00 a.m. of the same day. NOW, THEREFORE, THE CITY OF WINTER SPRINGS HEREBY ORDAINS: SECTION I - that Section 3-5 of the Code of Ordinances of the City of Winter Springs, Florida is hereby amended to read as follows: (1) It shall be unlawful for any person in the City of Winter Springs, Florida to sell, barter, exchange or in any manner deal in alcoholic beverages containing more than one percent of alcohol by weight between the hours of 2:00 a.m. and 7:00 a.m. of the same day (Ord. No. 183 Sl, 6-12-79). (2) It shall be unlawful for any person to consume in places of public accomodation any alcoholic beverage containing more than one percent of alcohol by weight between the hours of 2:00 a.m. and 7:00 a.m. of the same day. SECTION II - SEVERABILITY: If any section or portion of a section or subsection of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or portion of section or subsection or part of this ordinance. SECTION III - CONFLICTS: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION IV - EFFECTIVE DATE: This ordinance shall take effect immediately upon its final passage and adoption. PASSED and ADOPTED this 14 day of July 1981. CITY OF WINTER SPRINGS, FLORIDA By: Troy J.
