HomeMy WebLinkAboutOrdinance 236 Rezoning ORDINANCE NO. 236 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, REZONING THAT PART OF LOT 13 IN BLOCK C OF THE D. R. MITCHELL SURVEY OF THE LEVY GRANT ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 1, PAGE 5, OF THE PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA, LYING NORTH OF STATE ROAD 419, LESS THE SEABOARD COASTLINE RAILROAD RIGHT-OF-WAY, FROM ITS PRESENT ZONING CLASSIFICA- TION OF C-l TO C-2 PURSUANT TO CHAPTER 166.041 OF THE FLORIDA STATUES; PROVIDING FOR THE AMENDMENT OF THE OFFICIAL ZONING MAP AND THE CITY'S COMPREHENSIVE PLAN; SEVERABILITY; CONFLICTS AND EFFECTIVE DATE. WHEREAS, there has been an application to the City of Winter Springs, Florida, to rezone that patt of Lot 13, in Block C of the D. R. Mitchell Survey of the Levy Grant according to the Plat thereof as recorded in Plat Book 1, Page 5, of the Public Records of Seminole County, Florida, lying north of State Road 419, less the Seaboard Coastline Railroad Right- of -Way, from the present zoning classification of C-l to C-2, and that the owner of the subject property has authorized said application; and WHEREAS, the City finds that said requested zoning classification is in conformity with the present zoning classifications of other properties in the same immediate area and in conformity with the Winter Springs Compre- hensive Plan; and WHEREAS, the City has determined that it would be in the best interest of the City of Winter Springs, Florida, to grant said rezoning application. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WINTER SPRINGS, FLORIDA, HEREBY ORDAINS: SECTION I - That part of Lot 13, in Block C of the D. R. Mitchell Survey of the Levy Grant according to the Plat thereof as recorded in Plat Book 1, Page 5, of the Public Records of Seminole County, Florida, lying north of State Road 419, less the Seaboard Coastline Railroad Right-of- Way, is hereby rezoned from the present zoning classification of C-l to C-2. SECTION II - That the City Council of the City of Winter Springs has determined that a zoning classification of C-2 would be compatible with the surrounding property within theCity, and with the passage of this Ordinance, the City Council does hereby amend the Official Zoning Map of the municipal limits of the City of Winter Springs, Florida, and the City's Comprehensive Plan to include the subject property within the above-described designated zoning classification. SECTION III - If any section or portion of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or portion of a section or sub-section or part of this Ordinance. SECTION IV - That all Ordinances or parts of Ordinances in conflict herewith are hereby repealed. SECTION V - This Ordinance shall take effect immediately upon its final passage and adoption.
