AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA TO EXTEND
ITS TERRITORIAL AND MUNICIPAL LIMITS TO ANNEX THE HEREINAFTER
DESCRIBED LAND SITUATE AND BEING IN SEMINOLE OOUNTY, FLORIDA,
PURSUANT TO FLORIDA STATUTE 171.044; PROVIDING ZONING FOR THE
SUBJECT PROPERTY; PROVIDING FOR THE AMENDMENT OF THE OFFICIAL
ZONING MAP AND THE CITY'S COMPREHENSIVE LAND USE PLAN; PROVIDING
DIRECTIONS TO THE CITY CLERK; SEVERABILITY; CONFLICTS AND EFFECT-
IVE DATE.

WHEREAS Dunmar Estates/has petitioned the City Council of the City of
Winter Springs, Florida, to annex the property described as follows, as owner
thereof:
PARCEL A:
From the Southeast corner of Lot 147, Block "D", D. R. Mitchells Survey
of the Moses E. Levy Grant, as recorded in Plat Book 1, Page 5, P.R. of
Seminole County, Florida, run N.04 57'42"E. along the East line of said
Lot 147, and the West line of Gardena Farms Subdivision, as recorded in
Plat Book 6, Pages 23 and 24 of the Public Records of Seminole County,
Florida a distance of 300.00 feet for a point of beginning; run thence
further N.04 57'42"E. along said West line of Gardena Farms Subdivision,
and the East lines of Lots 147, 142, 134, 126 and 118, Block "0" of said
D. R.Mitchells Survey of the Moses E. Levy Grant, a distance of 3441.77
feet; run thence N.65 04'351" W 2081.84 feet to a point on the West line
of aforesaid Lot 118; run thence S.04 57'30' along the West line of
aforesaid Lots 118, 126, 134 and 142, a distance of 3862.15 feet to a
point on the NorSh line of aforesaid Lot 147, run thence along said

Winter Springs, Florida, to annex the property described as follows, as owner
thereof:

recorded in Plat Book 116", pages 23 and 24, Public Records of
Seminole County, Florida; run N. 04 57'42I1E. along said West line of
Gardena Farms 4101.58 feet for point of beginning; thence continue
N. 04057'42"8. 1875.98 feet; thence S. 83044'02 W. 1327.88 feet;

WHEREAS, the Charter of the City of Winter Springs, Florida, provides
for the annexation of property into the corporate limits when enacted by an Ordinance
of the said City, and pursuant to a petition of the land owners; and
WHEREAS, Florida Statute 171.044 of the General Laws of Florida provides
that a municipal corporation may annex property into its corporate limits, upon
the voluntary petition of the owners, by passing and adopting a non-emergency
ordinance to annex said property; and
WHEREAS, the City Council of the City of Winter Springs, Florida, is
desirous of annexing and redefining the boundaries of the municipality to include
the subject property pursuant to the authority contained in the City Charter of
the City of Winter Springs, Florida, and Florida Statute 171.044, General Laws of
Florida.
NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF WINTER
SPRINGS, FLORIDA, HEREBY ORDAINS:
SECTION I - That the City of Winter Springs, Florida, does herewith
and hereby annex and redefine the boundary lines of the municipality of the City of
Winter Springs, Florida, by including those certain contiguous lands lying in
Seminole County, Florida, and more particularly described as follows:

SECTION 11 - That the City Council of the City of Winter Springs has
determined that a zoning classification of R-U for Parcel A would be compatible
with the surrounding property within theCity. That the City Council of the City
of Winter Springs, upon concurrence and waiver of Florida Statute 171.062 by
Seminole County, has determined that a zoning classification of R-lA for Parcel
B would be compatible with the surrounding property within the City. With the
passage of this Ordinance, the City Council does hereby amend the Official Zoning
Map of the municipal limits of the City of Winter Springs, Florida, and the City's
Comprehensive Land Use Plan to include the aforesaid subject property within the
above described designated zoning classifications.
SECTION 111 - That upon passage and adoption of this ordinance, the
City Clerk is hereby directed to file a certified copy of this ordinance with
the Clerk of the Circuit Court in and for Seminole County, Florida, and to file
a certified copy with the Department of State of the State of Florida.
SECTION IV - If any section or portion of a section or subsection of this
ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be
held to invalidate or impair the validity, force or effect of any other section
or portion of a section or subsection or part of this Ordinance.
SECTION V - That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION VI - This ordinance shall take effect u.nediately upon its
final passage and adoption.
