ORDINANCE NO. 222
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA TO EXTEND
ITS TERRITORIAL AND MUNICIPAL LIMITS TO ANNEX THE HEREINAFTER
DESCRIBED LAND SITUATE AND BEING IN SEMINOLE COUNTY, FLORIDA,
PURSUANT TO FLORIDA STATUTE 171.044; PROVIDING ZONING FOR THE
SUBJECT PROPERTY; PROVIDING FOR THE AMENDMENT OF THE OFFICIAL
ZONING MAP AND THE CITY'S COMPREHENSIVE LAND USE PLAN; PROVIDING
DIRECTIONS TO THE CITY CLERK; SEVERABILITY; CONFLICTS AND
EFFECTIVE DATE.
WHEREAS, Walt Dittmer and Sons, Inc., has petitioned the City Council
of the City of Winter Springs, Florida, to annex the property described as
follows, as owner thereof:
PARCEL A:
That part of Lots 17 and 18 of SPRINGS HAMMOCK REPLAT, according to the
Plat thereof as recorded in Plat Book 7, Page 96 of the Public Records
of Seminole County, Florida, more particularly described as follows,
to-wit: Beginning at the Northwest corner of Lot 17, run thence
Easterly 354.6 feet along the North Line of said Lot 17 to the POINT
OF BEGINNING, run thence in a Southerly direction to a point on the
South Line of Lot 18, which point is 466.2 feet East of the Southwest
corner of said Lot 18, run thence westerly along the South Line of
said Lot 18, a distance of 100 feet, run thence in a Northerly direc-
tion to a point on the North Line of said Lot 17, which point is 254.6
feet East of the Northwest corner of said Lot 17, run thence in a
Easterly direction along the North Line of said Lot 17, 100 feet to th
POINT OF BEGINNING.
PARCEL B:
From the Northwest corner of Lot 17, SPRING HAMMOCK REPLAT, according
to the Plat thereof as recorded in Plat Book 7, Page 96, of the Public
Records of Seminole County, Florida, run East, along the North Line of
said Lot 17, 254.76 feet for a POINT OF BEGINNING, thence run South-
westerly, more or less, 197.2 feet to the Northerly Right-of-Way of
Shepard Road, said point being 366.2 feet East of the Easterly Right-
of-Way Line of U.S. HighwlY 17-92, thence run Westerly, along the
Northerly Right-of-Way Line of Shepard Road, 50 feet, thence run:
Northeasterly to the North Line of Lot 17, to a point 50 feet West of
thePOINT OF BEGINNING, thence run Easterly 50 feet to the POINT OF
BEGINNING.
PARCEL C:
BEGINNING at the Northwest corner of Lot 17, SPRING HAMMOCK REPLAT,
according to the Plat thereof as recorded in Plat Book 7, Page 96, of
the Public Records of Seminole County, Florida, thence run S.88052'00"
E., along the North Line of said Lot 17, a distance of 204.6 feet,
thence run S.0013'00"E. a distance of 198.97 feet to a point on the
Northerly Right-of-Way of Shepard Road, said point being 31602 feet
East of The Southwest corner of said lJot 18, thence run S.86 30'00"W.,
along the Northerly Right-of-Way of Shepard Road, a distance of 20.03
feet, thence run N.Oo13'OO"W:' a distance of 151.28 feet to the Point
of Curvature of a curve concave Southwesterly and having a radius of
30.00 feet, thence run Northwesterly, along the arc of said curve,
46.42 feet through a central angle of 88039'00" to the Point of
Tangency of said curve, thence run N.88052'00"W. a distance of 164.83
feet to the West Line of said Lot 17, thence rund Northeasterly, along
said Westerly Line, tohthe POINT OF BEGINNING; LESS that part lying
within the Right-of-Way of U.S. Highway 17-92 as established in
Official Records Book 68, page 408 of the Public Records of Seminole
County, Florida.
WHEREAS, the Charter of the City of Winter Springs, Florida, provides
for the annexation of property into the corporate limits when enacted by an
Ordinance of the said City, and pursuant to a petition of the land owners; and
WHEREAS, Florida Statute 171.044 of the General Laws of Florida
provides that a municipal corporation may annex property into its corporate
limits, upon the voluntary petition of the owners, by passing and adopting a
non-emergency ordinance to annex said property; and
WHEREAS, the City Council of the City of Winter Springs, Florida, is
desirous of annexing and redefining the boundaries of the municipality to
include the subject property pursuant to the authority contained in the City
Charter of the City of Winter Springs, Florida, and Florida Statute 171.044,
General Laws of Florida.
NOW, THEREFORE the City of Winter Springs, Florida, hereby ordains.
SECTION I - That the City of Winter Springs, Florida, does herewith
and does hereby annex and redefine the boundary lines of the municipality of
the City of Winter Springs, Florida, by including those certain contiguous lands
lying in Seminole County, Florida, and more particulary described as follows:
PARCEL A:
That part of Lots 17 and 18 of SPRING HAMMOCK REPLAT, according to
the Plat thereof as recorded in Plat Book 7, Page 96 of the Public
Records of Seminole County, Florida, more particularly described as
follows, to-wit: Beginning at the Northwest corner of Lot 17, run
thence Easterly 354.6 feet along the North Line of said Lot 17, to
the POINT OF BEGINNING, run thence in a Southerly direction to a
point on the South Line of Lot 18, which point is 466.2 feet East of
the Southwest corner of said Lot 18, run thence easterly along the
South Line of said Lot 18, a distance of 100 feet, run thence in a
Northerly direction to a point on the North Line of said Lot 17,

PARCEL B:

Public Records of Seminole County, Florida, run East, along the North
Line of said Lot 17, 254.76 feet for a POINT OF BEGINNING, thence run
Southwesterly, more or less, 197.2 feet to the Northerly Right-of-

feet, thence run S. 0013'00"E. a distance of 198.97 feet to a point
on the Northerly Right-of-Way of Shepard Road, said point being 316.2
feet East of the Southwest corner of said Lot 18, thence run S.860
30'00IlW., along the Northerly Right-of-Way of Shepard Road, a distance
of 20.03 feet, thence run N.0013IOO"W. a distance of 151.28 feet to
the Point of Curvature of a curve concave Southwesterly and having
a radius of 30.00 feet, thence run Northwesterly, along the arc of
said curve, 46.42 feet through a central angle of 8803910011 to the
Point of Tangency of said curve, thence run N.88052'00IlW. a distance
of 164.83 feet to the West Line of said Lot 17, thence run North-
easterly, along said Westerly Line, to the POINT OF BEGINNING; LESS
that part lying within the Right-of-Way of U.S. Highway 17-92 as
established in Official Records Book 68, Page 408 of the Public
Reoords of Seminole County Florida.
SECTION II - That the City Council of the City of Winter Springs has
determined that a zoning classification of C-2 would be compatible with the
surrounding property within the City, and with the passage of this Ordinance,
the City Council does hereby amend the Official Zoning Map of the municipal
limits of the City of Winter Springs, Florida, and the City's Comprehensive
Land Use Plan to include the subject property within the above described
designated zoning classification.
SECTION III - That upon passage and adoption of this ordinance, the
City Clerk is hereby directed to file a certified copy of this ordinance with
the Clerk of the Circuit Court in and for Seminole County, Florida, and to file
a certified copy with the Department of State of the State of Florida.
SECTION IV - If any section or portion of a section or subsection of
this ordinance proves to be invalid, unlawful, or unconstitutional, it shall
not be held to invalidate or impair the validity, force or effect of any other
section or portion of a section or subsection or part of this ordinance.
SECTION V - That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION VI - This ordinance shall take effect immediately upon its
final passage and adoption.
