ORDINANCE NO. 220
AN ORDINANCE OF THE CITY OF WINTER SPRINGS,
FLORIDA, CONVEYING THAT CERTAIN LAND DESIG-
NATED AS MINIATURE PARK AND CONSISTING OF THE
CREEK BED OF GEE CREEK AND PREVIOUSLY PLATTED
IN THE PLAT OF NORTH ORLANDO RANCHES, SECTION
TWO, RECORDED IN PLAT BOOK 12, PAGE 12, PUBLIC
RECORDS OF SEMINOLE COUNTY, FLORIDA; PROVIDING
FOR THE RESERVATION OF AN EASEMENT TO THE CITY
OF WINTER SPRINGS, FLORIDA, FOR PURPOSES OF
EMERGENCY MAINTENANCEi CONFLICTS AND EFFECTIVE
DATE.
WHEREAS, Section 4.14(6) of the City Charter for the
City of Winter Springs, Florida, provides that a conveyance of City
property by the City shall be done by ordinance; and
WHEREAS, Section 177.101 of the Florida Statutes pro-
vides for the vacation and annulment of plats subdividing land in
whole or in part within the corporate limits of any incorporated
city within the State of Florida by resolution and the City Council
for the City of Winter Springs, Florida having previously adopted
Resolution Number 306 accomplishing same; and
WHEREAS, the City Council of the City of Winter Springs,
Florida, has determined it to be in the best interest of the City of
Winter Springs to convey those lands designated as Miniature Park
and consisting of the creek bed of Gee Creek to the adjacent property
owners to the center line of said Gee Creek,
NOW, THEREFORE, the City Council of the City of Winter
Springs, Florida, hereby ordains:
SECTION I - That the area of land designated as Miniature
Park and consisting of the creek bed of Gee Creek previously platted
in the Plat of North Orlando Ranches, Section Two, recorded in Plat
Book 12, Page 12, of the Public Records of Seminole County, Florida,
shall be conveyed by the City of Winter Springs, Florida, to the
adjacent property owners to the center line of Gee Creek and shall
accomplish same by individual Quit Claim Deeds to the adjacent property
owners and the cost of the preparation and recording of said deeds
shall be borne by said adjacent property owners.
SECTION II - That the City of Winter Springs, Florida,
shall reserve in its favor an easement for purposes of emergency
maintenance.
SECTION III - SEVERABILITY. If any section or portion of
a section or subsection of this Ordinance proves to be invalid, unlaw-
ful or unconstitutional, it shall not be held to invalidate or impair
the validity, force or effect of any other section or portion of a
section or subsection or part of this ordinance.
SECTION IV - CONFLICTS. That all ordinances or parts
of ordinances in conflict herewith are hereby repealed.
SECTION V -EFFECTIVE DATE. This ordinance shall take
effect upon final passage and adoption.
