HomeMy WebLinkAboutOrdinance 212 Rezoning/Sheoah Golf ORDINANCE NO. 212 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, REZONING THE HEREINAFTER DESCRIBED LANDS, PART OF SHEOAH GOLF COURSE FRONT ING ON S. R. 434 AND LYING WITHIN THE BOUNDARIES OF THE HIGHLANDS P.U.D., IN THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, FROM ITS PRESENT ZONING CLASSIFICATION OF PLANNED UNIT DEVELOPMENT TO C-l NEIGHBORHOOD COMMERCIAL PURSUANT TO CHAPTER 166.041 OF THE FLORIDA STATUTES; PROVIDING FOR THE AMENDMENT OF THE OFFICIAL ZONING MAP AND THE COMPREHENSIVE LAND USE MAP; SEVERABILITY; CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City Council of the City of Winter Springs, lorida, has determined it to be in the best interest of the health, safety nd welfare of the citizens of Winter Springs, Florida, to rezone from its resent zoning classification of Planned Unit Development to C-l Neighborhood the following described real property situate in Winter Springs, lorida: Begin at the Southwest corner of Tract "I", said corner being on the North right-of-way line of the Longwood Wagner Road (State Road No. S- 434); as per plat of "The Highlands Section Three", recorded in Plat Book 176 Pages 48 and 49, Public Records of Seminole County, Florida; thence run N.ll 49'30"E. algng the West line of said Tract "1"6 a distance of 401.39 feet; thence S.82 53'3l"E. 1946.12 feet; thence S.OO 49'13"E. 403.86 feet to a point on the Southerly line of said Tract "I"; thence run along said Southerly line of Tract "I", and the Southerly line of Tract "K", of said ''The Highlands Section Three", the following courses: Run N.82053'3l''W. 190.45 feet; thence 000 N.07 06'2~'E. 10.00 feet; thence N.82 53'3l'~. 200.06 feet; thence S.07 06'2~'W. 10.00 feet; thence N.8205313l''W. 286.90 feet; thence N.00049'13''W. 91.80 feet; thence N.89oS9'34"W. 735.75 feet; thence N.82053'31''W. 614.65 feet to the point of beginning, containing 17.4575 acres more or less. WHEREAS, the City Council finds that said requested zoning classification is in conformity with the present zoning classifications of other properties in the same immediate area and in conformity with the Winter Springs Comprehensive Plan; and WHEREAS, the City Council has determined that it would be in the best interest of the City of Winter Springs, Florida, to grant said rezoning application. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WINTER SPRINGS, FLORIDA, HEREBY ORDAINS: SECTION I - That the City of Winter Springs, Florida, does herewith and hereby rezone from its present zoning classification of Planned Unit Development to C-l Neighborhood Commercial the following described real property: Begin at the Southwest corner of Tract "I", said corner being on the North right-of-way line of the Longwood Wagner Road (State Road No. S- 434); as per plat of ''The Highlands Section Three", recorded in Plat Book 17& Pages 48 and 49, Public Records of Seminole County, Florida; thence run N.ll 49' 30"E. algng the West line of said Tract "1"& a distance of 401.39 feet; thence S.82 53'3l"E. 1946.12 feet; thence S.OO 49'13"E. 403.86 feet to a point on the Southerly line of said Tract "I"; thence run along said Southerly line of Tract "I", and the Southerly line of Tract "K", of said "The Highlands Section Three", the following courses: Run N.82053'3l''W. 190.45 feet; thence N.07 06'29"E. 10.00 feet; thence N.82 53'3l"W. 200.06 feet; thence S.07 06'29"w. 10.00 feet; thence N.82 53'3l"W. 286.90 feet; thence N.OO 49'13"W. 91.80 feet; thence N.89059'34''W. 735.75 feet; thence N.82053'3l''W. 614.65 feet to the point of beginning, containing 17.4575 acres more or less. SECTION II - That the City Council of the City of Winter Springs has determined that a zoning classification of C-l would be compatible with the surrounding property within the City and with the City's Comprehensive Plan and with the passage of this Ordinance the City Council does hereby amend the Official Zoning Map and the Comprehensive Land Use Map of the municipal limits of the City of Winter Springs, Florida, to include the subject property within the above described designated zoning classification. SECTION III - If any section or portion of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or portion of a section or subsection or part of this Ordinance. SECTION IV - That all parts of Ordinances in conflict herewith are hereby repealed. SECTION V - This Ordinance shall take effect immediately upon its final passage and adoption.
