ORDINANCE NO. 210
AN ORDINANCE OF THE CITY OF WINTER SPRINGS,
FLORIDA, REZONING THE HEREINAFTER DESCRIBED
LANDS, LOCATED SOUTH OF STATE ROAD 419, WEST
OF TUSCAWILLA ROAD AND EAST OF MOCKINGBIRD
LANE, IN THE CITY OF WINTER SPRINGS, SEMINOLE
COUNTY, FLORIDA, FROM ITS PRESENT ZONING
CLASSIFICATION OF R-U RURAL URBAN DWELLING TO
R-lA ONE-FAMILY DWELLING PURSUANT TO CHAPTER
166.041 OF THE FLORIDA STATUTES; PROVIDING FOR
THE AMENDMENT OF THE OFFICIAL ZONING MAP AND
THE COMPREHENSIVE LAND USE MAP; SEVERABILITY;
CONFLICTS AND EFFECTIVE DATE.
WHEREAS, the City Council of the City of Winter Springs,
Florida, has determined it to be in the best interest of the health, safety
and welfare of the citizens of Winter Springs, Florida, to rezone from its
present zoning classification of R-U Rural Urban Dwelling to R-lA One-Family
Dwelling the following described real property situate in Winter Springs,
Florida:
Beginning at a point S00053'23" E 50.00/from the southeast
corner of Lot 1, Block 12, of North Orlando Ranches Section 10, as recorded
in Plat Book 13, Pages 32 and 33, of the Public Records of Seminole County,
Florida; run along the southerly and easterly boundary of said North Orlando
Ranches Section 10 to the southeast corner of North Orlando Ranches Section 9,
as recorded in Plat Book 13, Pages 11 and 12, of the Public Records of
Seminole County, Florida; thence run N 10 09'56" W 734.02 feet to a point on
the proposed southerly right of way line of Alton Road; thence run along the
proposed southerly and easterly right of way lines of said Alton Road throggh
the following courses and distances; thence from a tangent bearing of S 89 44'
23" E run easterly along the arc of a curve concave southerly having a radius
of 236.62 feet, a distance of 83.52 feet through a central angle of 20013'29"
to the point of reverse curvature of a cgrve concave northerly having a radius
of 316.62 feet and a central angle of 20 29'29"; thence run easter16 along the
arc of said curve 113.24 feet to the point of tangency; thence N 89 59'37" E
343.89 feet; thence N 00000'23" W 601.01 feet to the point of curvature of a
curve concave westerly having a radius of 440.00 feet and a central angle of
40 04'17"; thence run northerly along the arc of said curve 307.73 feet to the
point of tangency; thence run N 40 04'40" W 249.11 feet to a point of inter-
section with the north line of AN 110.00 foot wide Florida Power and Light
Company easement; thence run N 89 59'37" E along said north line and an east-
erly projection thereof and the northerly line of lots 34, 33, 32, 31, 30, 29
and 28, Block "D", D. R. Mitchell's survey of the Levy Grant on Lake Jessup,
as recorded in Plat Book 1, Page 5, of the Public Records of Seminole County,
Florida, to the northeast corner of said Lot 28; thence run S 01005'12" E
along the east line of Lots 28, 39, 62 and 75, Block "D", of said D. R. Mitch-
ell's survey of the Levy Grant on Lake Jessup, and a southerly projection of
said east line 4634.91 feet to a point on the southerly line of Lot 73 of said
Block "D:; said point also being on the northerly line of Gardena Farms as
recorded in Plat Book 6, Pages 23 and 24 of the Public Records of Seminole
County, Florida; thence run N 78 42'57" W along said line to the northwest
corner of said Gardena Farms; thence run southerly along the westerly line of
said Gardena Farms to a point on the south boundary of the lands owned by
Florida Land Company; said point lying easterly from a point 20.93 ft. south
of the northeast corner of North Orlando Ranches Section 1, as recorded in
Plat Book 12, Page J, Public Records of Seminole County, Florida, as measured
along the east line of said plat; thence run westerly 3459+ feet to the afore-
mentioned east line of said plat; thence run northerly along said east line
20.93 feet to the aforementioned northeast corner of North Orlando Ranches
Section 1; said corner also being the southeast corner of North Orlando Ranches
Section 5 as recorded in Plat Book 12, Pages 58 and 59 of the Public Records of
Seminole County, Florida; thence run northerly along the easterly line of said
plat to the point of beginning.
Less the following described tract of land:
Beginning at the northeast corner of Lot 28, Block "D", D.R.Mitchell's survey
of the Levy Grant on Lake Jessup, as recorded in Plat Book 1, Page 5, of the
Public Records of Seminole County, Florida, run S 01 05'12" E along the east
line of Lots 28, 39, 62 and 75, Block "0" of said Plat and a southerly projec-
tion thereof 4634.91 feet to a point on the southerly line of Lot 73, Block
"0", of said D. R. Mitchell's survey of the Levy Grant on Lake Jessup; thence
run N 78 42' 57" W along said south line 1077.30 ft., thence N 14 30'23" W
412.08 feet thence N 01 00'23" W 665 feet; thence N 21 59'37" E 580.00 feet;
thence N 16 30'23" W 590.00 feet; thence N 01 30'23" W 495.00 feet; thence
N 09 29'37" E 615.00 feet; thence N 08 00'23" W 495.00 feet; thence N 31 30'23"
W 395.00 feet; thence N 33 59'37" E 395.00 feet to a point on the westerly
projection of the north line of aforementioned Lot 28, Block "0"; thence run
N 89 59'37" E along said line 1000 feet to the point of beginning. Containing
305+ Acres.
WHEREAS, the City Council finds that said requested zoning
classification is in conformity with the present zoning classifications of
other properties in the same immediate area and in conformity with the Winter
Springs Comprehensive Plan; and
WHEREAS, the City Council has determined that it would be
in the best interest of the City of Winter Springs, Florida, to grant said
rezoning application.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
WINTER SPRINGS, FLORIDA, HEREBY ORDAINS:
SECTION 1 - That the City of Winter Springs, Florida, does
herewith and hereby rezone from its present zoning classification of R-U to
R-1A the following described real property:
Beginning at a point S00053'23" E 50.00 feet from the south-

N 16 30'23" W 590.00 feet; thence N 01030'23" W 495.00 feet; thence N 09029'37"
E 615.00 feet; thence N 08 00'23" W 495.00 feet; thence N 31 30'23" W 395.00
feet; thence N 33 59'37" E 395.00 feet to a point on the westerly projection of
the north line of aforementioned Lot 28, Block "D"; thence run N 89 59'37" E
along said line 1000' feet to the point of beginning; Containing therein 305+
Acres.
SECTION II - That the City Council of the City of Winter
Springs has determined that a zoning classification of R-1A would be compatible
with the surrounding property within the City and with the City's Comprehensive
Plan and with the passage of this Ordinance the City Council does hereby amend
the Official Zoning Map and the Comprehensive Land Use Map of the municipal
limits of the City of Winter Springs, Florida, to include the subject property
within the above described designated zoning classification.
SECTION III - If any section or portion of this ordinance
proves to be invalid, unlawful or unconstitutional, it shall not be held to
invalidate or impair the validity, force or effect of any other section or
portion of a section or subsection or part of this Ordinance.
SECTION IV - That all parts of Ordinances in conflict
herewith are hereby repealed.
SECTION V - This Ordinance shall take effect immediately
upon its final passage and adoption.
