This First Amendment ("Amendment") is made and entered into by and between
WENDELL E. SPEARS, whose address is 7925 South Park Place, Orlando, FL 32819
("Grantor") and ECK WINTER SPRINGS 9, INC., a Florida corporation whose address
is 5301 Conroy Road, Suite 180, Orlando, FL 32811 ("Eck-Winter Springs") and the
CITY OF WINTER SPRINGS, whose address is 1126 East State Road 434, Winter
Springs, FL 32708 (the "City"), (collectively the "Grantees").
WITNESSETH:
WHEREAS, Grantor granted a Non-Exclusive Utility Easement Agreement on
the 1st day of February, 2000 and same being recorded February 4, 2000 in Official
Records Book 3797, Page 1598, Public Records of Seminole County, Florida.
WHEREAS, the parties mutually agree to Amend the Non-Exclusive Utility
Easement Agreement to the addition of the following:
1. Grant of Easement: (a) Grantor and Grantee correct the legal description
of the Utility Easement recorded in O.R. Book 3797, Page 1598, Public
Records of Seminole County, Florida, to that description as shown on
Exhibit "c" attached hereto and made a part hereof; (b) Grantor hereby
grants and conveys unto Grantee a non-exclusive easement over, under
and across the portion of the Grantor Parcel described on the revised
Exhibit C, attached hereto and incorporated herein by this reference (the
"Easement Property"). Grantor grants the easement for the purpose of
allowing Grantee to enter upon the Easement Property to install,
construct, maintain, repair, or replace a multi tenant monument sign, in
that location noted on the revised Exhibit "C".
2. Remaining Terms Unaffected: Except as specifically modified and
amended hereby, the Agreement remains in full force and effect.
3. Counterparts/Facsimile Signatures: This Amendment may be executed
in one or more counterparts, all of which shall collectively constitute a
single agreement. Facsimile signatures hereof shall be binding and
deemed original.
