Norton Signed City Clerk ORDINANCE NO. 191 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, ADOPTING THE "WINTER SPRINGS ENERGY EFFICIENCY BUILDING CODE", WHICH SETS FORTH MINIMUM REQUIREMENTS FOR THERMAL AND LIGHTING EFFICIENCY DESIGN STANDARDS FOR USE WITHIN THE CITY OF WINTER SPRINGS; PROVIDING FOR INCLUSION IN THE WINTER SPRINGS CODE OF ORDINANCES; REPEALING ORDINANCES IN CONFLICT THEREWITH; PROVIDING FOR SEVERABILITY; CONFLICTS AND EFFECTIVE DATE. WHEREAS, the Florida Legislature has enacted Section 553.89, Florida Statutes, known and cited as the "Florida Lighting Efficiency Code"; and WHEREAS, the Florida Legislature also enacted Sections 553.900 through 553.908, Florida Statutes, known and cited as the "Florida Thermal Efficiency Code" and WHEREAS, the above cited statutes make it mandatory for the City of Winter Springs, Florida, to enforce an Energy Efficiency Building Code; and WHEREAS, the State of Florida has prepared a model Energy Efficiency Building Code, which includes options on seven (7) pages; and WHEREAS, the City Council for the City of Winter Springs, Florida, desires to adopt the State of Florida Model Efficiency Building Code for use in the City of Winter Springs; and WHEREAS, the City Council for the City of Winter Springs, has opted to include pages 1-2, 1-4, 5-15, 5-16, 5-17, 6-4 and 6-5 of the State of Florida Model Efficiency Building Code, rather than pages l-2A, l-4A, 5-l5A, 5-l6A, 5-l7A, 6-4A and 6-5A; and WHEREAS, the City Council for the City of Winter Springs has amended Section 101.3(a)(2)(f) of the Model Energy Efficiency Building Code to read "any commercial building with a heated or cooled area of less than 1,500 square feet." NOW, THEREFORE, the City of Winter Springs, Florida, hereby ordains: SECTION I - That the State of Florida Model Energy Efficiency Building Code, dated November of 1978, which is attached hereto as Exhibit "A" is hereby adopted as the "Winter Springs Energy Efficiency Building Code" for use within Winter Springs, Florida. SECTION II - It is the intention of the City Council for the City of Winter Springs, that the provisions of this Ordinance shall become and made a part of the Winter Springs Code of Ordinances, pro- viding, however, that Exhibit "A" shall not be codified but shall be available at the Building Department of Winter Springs, Florida. SECTION III - That the "Winter Springs Energy Efficiency Building Code" may be amended by the City Council for the City of Winter Springs, Florida, by the adoption of a resolution. SECTION IV - If any section or portion of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or portion of a section or subsection of this Ordinance. SECTION V - That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION VI - This Ordinance shall take effect immediately upon its passage and adoption.
