HomeMy WebLinkAboutOrdinance 183 Alcoholic Beverages ORDINANCE NO. 183 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA AMENDING SECTION 3-5 OF THE WINTER SPRINGS CODE OF ORDINANCES RESTRICTING THE HOURS OF SALE OF CERTAIN ALCOHOLIC BEVERAGES IN WINTER SPRINGS; PROVIDING FOR. SEVERABILITY; PROVIDING FOR CONFLICTS AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Winter Springs, Florida has determined it to be in the interest of the public's health, safety and welfare to limit the hours during which one can buy alcoholic beverages containing more than one (1) percent of alcohol by weight. WHEREAS, the City Council of the city of Winter Springs, Florida has determined that it is in the interest of the publics health, safety and welfare to render it unlawful for any person to sell, barter, exchange or in any manner deal in alcoholic beverages containing more than one percent (1%) of alcohol by weight between the hours of 2:00 a.m. and 7:00 a.m. of the same day. NOW, THEREFORE, THE CITY COUNCIL OF THF CITY OF WINTER SPRINGS, FLORIDA HEREBY ORDAINS: Section (1) Section 3-5 of the Code of Ordinances of the City of Winter Springs, Florida is amended to read as follows: SECTION 3-5 - HOURS OF SALE It shall be unlawful for any person in the City of Winter Springs to sell, barter, exchange or in any manner deal in alcoholic beverages containing more than one (1) percent of alcohol by weight between the hours of 2:00 a.m. and 7:00 a.m. of the same day. SECTION (2) - SEVERABILITY - If any section or portion of a section or subsection of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or portion of a section or subsection or part of this Ordinance.
