ORDINANCE NO. 164
AN ORDINANCE OF THE CITY OF WINTER SPRINGS,
FLORIDA TO EXTEND ITS TERRITORIAL AND
MUNICIPAL LIMITS TO ANNEX THE HEREINAFTER
DESCRIBED LANDS SITUATE AND BEING IN
SEMINOLE COUNTY, FLORIDA, PURSUANT TO
FLORIDA STATUTES l7l.044; PROVIDING ZONING
FOR THE SUBJECT PROPERTY; PROVIDING FOR THE
AMENDMENT OF THE OFFICIAL ZONING MAP AND
THE CITY'S COMPREHENSIVE LAND USE PLAN;
PROVIDING DIRECTIONS TO THE CITY CLERK;
SEVERABILITY AND EFFECTIVE DATE
WHEREAS, MICHAEL S. ALEXATOS, TRUSTEE, has petitioned
the City Council of the City of Winter Springs, Florida to annex
the property described as follows:
Lots 1 and 2, Entzminger Farms Addition No.2,
according to the plat thereof, as recorded in
Plat Book 5, Page 9, of the Public Records of
Seminole County, Florida, less the West 194 feet
of Lot 1; together with all of the right-of-way
of Old Sanford-Oviedo Road lying due South of
the aforedescribed parcel.
WHEREAS, the Charter of the City of Winter Springs,
Florida provides for the annexation of property into the corporate
limits when enacted by an Ordinance of the said City, and pursuant
to a petition of the land owners, and
WHEREAS, Florida Statute 171.044 of the General Laws
of Florida provides that a municipal corporation may annex
property into its corporate limits, upon the voluntary petition
of the owners, by passing and adopting a non-emergency ordinance
to annex said property, and
WHEREAS, the City Council of the City of Winter Springs,
Florida is desirous of annexing and redefining the boundary lines
of the municipality to include the subject property pursuant to
the authority contained in the City Charter of the City of
Winter Springs, Florida and Florida Statute l7l.044, General
Laws of Florida.
NOW, THEREFORE, THE CITY OF WINTER SPRINGS HEREBY
ORDAINS:
Section (I) That the City of Winter Springs, Florida
does herewith and hereby annex and redefine the boundary lines of

the municipality of the City of Winter Springs by including
those certain contiguous lands lying in Seminole County, Florida,
and more particularly described as follows:
Lots 1 and 2, Entzminger Farms Addition No.2,
according to the plat thereof, as recorded in
Plat Book 5, Page 9, of the Public Records of
Seminole County, Florida, less the West 194 feet
of Lot l; together with all of the right-of-way
of Old Sanford-Oviedo Road lying due South of
the aforedescribed parcel.
Section (2) That the City Council of the City of
Winter Springs has determined that a zoning classification of
RU would be compatible with the surrounding property within the
City, and with the passage of this Ordinance, the City Council
does hereby amend the Official Zoning Map of the municipal limits
of the City of Winter Springs, Florida and the City's Comprehensive
Land Use Plan to include the subject property within the above-
described designated zoning classification.
Section (3) That upon passage and adoption of this
Ordinance the City Clerk is hereby directed to file a certified
copy of this Ordinance with the Clerk of the Circuit Court in
and for Seminole County, Florida, and to file a certified copy
with the Department of State of the State of Florida.
Section (4)
If any section or portion of a section or
subsection of this Ordinance proves to be invalid, unlawful or
unconstitutional, it shall not be held to invalidate or impair
the validity, forde or effect of any other section or portion of
section or subsection or part of this Ordinance.
Section (5) That all Ordinances or parts of Ordinances
in conflict herewith are hereby repealed.
Section (6) This Ordinance shall take effect immediately
upon its final passage and adoption.

TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN by the City Council of the
City of Winter Springs, Florida, that said City Council will
reconvene and continue its Public Hearing at the City of
Winter Springs Community Building on November 14, 1978, at
7:30 p.m., or as soon thereafter as possible to further con-
sider an Ordinance entitled as follows:

FLORIDA, TO EXTEND ITS TERRITORIAL AND
MUNICIPAL LIMITS TO ANNEX THE HEREINAFTER
DESCRIBED LANDS SITUATE AND BEING IN
SEMINOLE COUNTY, FLORIDA, PURSUANT TO
FLORIDA STATUTE 171.044; PROVIDING ZONING
FOR THE SUBJECT PROPERTY; PROVIDING FOR THE
AMENDMENT OF THE OFFICIAL ZONING MAP AND
THE CITY'S COMPREHENSIVE LAND USE PLAN;
PROVIDING DIRECTIONS TO THE CITY CLERK;

The property to be annexed is described as:
Lots 1 and 2, Entzminger Farms Addition
No.2, according to the plat thereof as
recorded in Plat Book 5, page 9, of the
Public Records of Seminole County, Florida,
less the West 194 feet of Lot 1; together
with all of the right-of-way of Old Sanford-
Oviedo Road lying due South of the afore-
described parcel.
A copy of said Ordinance shall be available at the
Office of the City Clerk of the City of Winter Springs, Florida,
for all persons desiring to examine same.
All interested parties are invited to attend and
be heard.
THIS NOTICE is to be published in the Sanford Evening
Herald, a newspaper of general circulation in the City, one
(1) time at least fifteen (15) days prior to the time of the
public hearing.
