ORDINANCE NO. 160 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA TO EXTEND ITS TERRITORIAL AND MUNICIPAL LIMITS TO ANNEX THE HEREINAFTER DESCRIBED LANDS SITUATE AND BEING IN SEMINOLE COUNTY, FLORIDA, PURSUANT TO FLORIDA STATUTES 171.044; PROVIDING ZONING FOR THE SUBJECT PROPERTY; PRO- VIDING FOR THE AMENDMENT OF THE OFFICIAL ZONING MAP; PROVIDING DIRECTIONS TO THE CITY CLERK; SEVERABILITY AND EFFECTIVE DATE. WHEREAS, Clifford D. Jordan and Ambrose Zaccarello have petitioned the City Council of the City of Winter Springs, Florida to annex the property described as follows: Begin at the intersection of the East line of Lot 17, Block D, of D. R. Mitchell's Survey of Levy Grant re- corded in Plat Book 1, Page 5, public records of Seminole County, Florida with Southerly right-of-way line of Long- wood-Wagner Road, State Road 434 for P.O.B., run Westerly along said right-of-way 625.94 feet thence South 5 degrees 47 minutes 30 seconds East 193.0 feet, thence Northerly along South line of said Lot 17, North 83 degrees 55 minutes, East 639.0 feet thence North on East line of said Lot 17, Block D, D. R. Mitchell's Survey of Levy Gran 111.25 feet to P.O.B. WHEREAS, the Charter of the City of Winter Springs, Florida provides for the annexation of property into the corporate limits when enacted by an Ordinance of the said City, and pursuant to a petition of the land owners, and WHEREAS, Florida Statute 171.044 of the General Laws of Florida provides that a municipal corporation may annex property into its corporate limits, upon the voluntary petition of the owners, by passing and adopting a non-emergency ordinance to annex said property, and WHEREAS, the City Council of the City of Winter Springs, Florida is desirous of annexing and redefining the boundary lines of the municipality to include the subject property pursuant to the authority contained in the City Charter of the City of Winter Springs, Florida and Florida Statute 171.044, General Laws of Florida. NOW THEREFORE, THE CITY OF WINTER SPRINGS HEREBY ORDAINS: Section (1) That the City of Winter Springs, Florida, does herewith and hereby annex and redefine the boundary lines of the municipality of the City of Winter Springs by including those certain contiguous lands lying in Seminole Count:y, Florida, and more particularly described as follows: 063360 May 5 12 12 PM '82 OFFICIAL RECORDS BOOK 1381 PAGE 0242 SEMINOLE CO. FL. Begin at the intersection of the East line of Lot 17, Block D, of D. R. Mitchell's Survey of Levy Grant as recorded in Plat Book 1, Page 5, public records of Seminole County, Florida with Southerly right-of-way line of Longwood-Wagner Road, State Road 434 for P.O.B. run Westerly along said right-of-way 625.94 feet thence South 5 degrees 47 minutes 30 seconds East 193.0 feet, thence Northerly along South line of said Lot 17, North 83 degrees 55 minutes, East 639.0 feet thence North on East line of said Lot 17, Block D, D. R. Mitchell's Survey of Levy Grant 111.25 feet to P.O.B. Section (2) That the City Council of the City of Winter Springs has determined that a zoning classification of C-2 would be compatible with the surrounding property within the City, and with the passage of this Ordinance, the City Council does hereby amend the Official Zoning Map of the municipal limits of the City of Winter Springs, Florida, to include the subject property with the above-described designated zoning classifica- tion. Section (3) That upon passage and adoption of this Ordinance the City Clerk is hereby directed to file a certi- fied copy of this Ordinance with the Clerk of the Circuit Courtr in and for Seminole County, Florida, and to file a certified copy with the Department of State of the State of Florida. Section (4) If any section or portion of a section or subsection of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section, or portion of section or subsection or part of this Ordinance. Section (5) That all Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section (6) This Ordinance shall take effect immediately upon its final passage and adoption.
