HomeMy WebLinkAboutOrdinance 158 Comprehensive Plan ORDINANCE NO. 158 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, ADOPTING THE WINTER SPRINGS COMPREHENSIVE PLAN, PUR- SUANT TO FLORIDA STATUTES CHAPTER 163 AND PURSUANT TO THE SEMINOLE COUNTY COMPREHENSIVE PLANNING ACT OF 1974; CITY CLERK DIRECTIONS; CONFLICTS; SEVERABILITY AND EFFECTIVE DATE. WHEREAS, in order to protect human, environmental, social and economic resources; and to maintain through orderly growth and development, the character and stability of present and future land use, and WHEREAS, the adoption of a comprehensive plan is necessary to preserve and enhance present advantages; encourage the most ap- propriate use of land, water, and resources, consistent with the public interest; overcome present handicaps; and deal effectively with future problems that may result from the use and development of land in Winter Springs, and WHEREAS it is the intent of the City of Winter Springs to preserve, promote, protect, and improve the public health, safety, comfort, good order, appearance, convenience, law enforcement and fire prevention and general welfare; and to prevent the overcrowd- ing of land and avoid undue concentration of population, and to facilitate the adequate and efficient provision of transportation, water, sewerage, schools, parks, recreational facilities, housing and other requirements and services; and to conserve, develop, utilize, and protect natural resources within the City of Winter Springs, and WHEREAS, in order to accomplish the above designated goals it is necessary to adopt a Comprehensive Land Use Plan that comp- lies with the Seminole County Comprehensive Planning Act of 1974 and the Local Government Comprehensive Planning Act of 1975. NOW THEREFORE, be it Ordained by the City of Winter Sprins: SECTION (1). That the Winter Springs Comprehensive Plan attached hereto as Exhibit "A" and incorporated herein and made a part hereof by reference is hereby adopted as the minimum require ments for land use in the City of Winter Springs, Florida. SECTIONQ2). That no public or private development shall be permitted except in conformity with the Comprehensive Plan or elements or portions thereof. SECTION (3). That the City of Winter Springs in adopting the Comprehensive Plan has complied with all the requirements of the Seminole County Comprehensive Planning Act of 1974 and the Local Government Comprehensive Planning Act of 1975 including but not being limited to public participation in the development of the plan and dissemination of the plan to other units of local govern- ment and the local Planning Agency of the County. SECTION (4). The City Clerk is hereby directed to transmit a copy of the Comprehensive Plan or element or portion thereof to the State Land Planning Agency, appropriate regional agency, County Land Planning Agency and to any other unit of local government which has filed with the City of Winter Springs a request for copies of the adopted Comprehensive Plan or elements or portions thereof. SECTION (5). Conflicts. This Ordinance shall not be con- strued to have the effect of repealing any existing Ordinance con- cerning the subject matter of this Ordinance, but the regulations established herein shall be supplemental and cumulative; however, in the case of a direct conflict with a provision or provisions of any existing Ordinance, the provision which is more restrictive and imposes higher standards or requirements shall govern. SECTION (6). Severability. If any section, part of a section, paragraph, sentence, clause, phrase, or word of this Ordinance is, for any reason, held or declared to be unconstitution- aI, inoperative, or void, such holding of invalidity shall not effect the remaining portions of this Ordinance; and it shall be construed to have been the legislative intent to pass this Ordin- ance without such unconstitutional, invalid or inoperative part therein, and the remainder of this Ordinance, after the exclusion of such part or parts, shall be deemed to be valid and if this Ordin- ance or any provisions thereof shall be held inapplicable to any person, group of persons, property, kind of property, circumstances, or set of circumstances, such holding shall not affect the applica- tion hereof to any other person, property or circumstance. SECTION (7). Effective Date. This Ordinance shall take -2- effect immediately upon passage and adoption. PASSED AND ADOPTED this 26 day of September, 1977.
