HomeMy WebLinkAboutOrdinance 155 Rezoning ORDINANCE NO. 155 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA REZONING CERTAIN LANDS THEREIN AS HEREIN DEFINED FROM R1A TO Cl: CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. WHEREAS, the following described properties are located within the City of Winter Springs, Florida, and are currently in a zoning classification of R1A: Lots 10 and 11 of Block 16, North Orlando Subdivision, as recorded in Plat Book 12, pages 10 and 11, Official Records of Seminole County, Florida, WHEREAS, the City Council of Winter Springs, Florida, deems it to be in the best public interest of the citizens of Winter Springs, Florida, and in order to promote the general welfare of the citizens of Winter Springs, Florida, to rezone the above parcel of real property to the zoning classification of C1, and NOW, THEREFORE, be it ordained by the City of Winter Springs, Florida, 1. That the City Council, in order to promote the general welfare of the citizens of Winter Springs, Florida, and to establish the highest and best use of real property with- in the City of Winter Springs, Florida, does hereby rezone the following described parcel of real property which are located within Winter Springs, Florida, from their present zoning classification R1A to a zoning classification of C1: Lots 10 and 11 of Block 16, North Orlando Subdivision, as recorded in Plat Book 12, pages 10 and 11, Official Records of Seminole County, Florida. 2. That after the passage of this Ordinance, the Zoning Administration is directed to officially change the zoning map of the City indicating thereon the Ordinance number and date of final passage, rezoning the above described real property. 3. Conflicts. This Ordinance shall not be construed to have the effect of repealing any existing Ordinance concerning the subject matter of this Ordinance, but the regulations established herein shall be supplemental and cumulative; however, in the case of a direct conflict with a provision or provisions of any existing Ordinance the provision which is more restrictive and imposes higher standards or requirements shall govern. 4. Severability. If any section, part of a section, paragraph, sentence, clause, phrase, or word of the Ordinance is, for any reason, held or declared to be unconstitutional, inoperative, or void, such holding of invalidity shall not affect the remaining por- tions of this Ordinance and it shall be construed to have been the legislative intent to pass this Ordinance without such unconstitutional, invalid or inoperative part therein, and the remainder of this Ordinance, after the exclusion of such part or parts, shall be deemed to be held valid as if this Ordinance, or any provisions thereof, shall be held inapplicable to any person, group of persons, property, kind of property, circum- stances, or set of circumstances, such holding shall not affect the application hereof to any other person, property or circum- stances. 5 . Effective Date . This Ordinance shall take effect immediately upon passage and adoption. PASSED AND ADOPTED this 8th day of August, 1977. Works Complex CITY OF WINTER SPRINGS, FLORIDA TO WHOM IT MAY CONCERN: NOTICE IS HEREBY GIVEN by the City Council of the City of Winter Springs, Florida, that said City Council will hold a public hearing on Monday, July 2.5,1977, at 7:30 P.M. or as soon thereafter as possible to consider an Ordinance entitled as follows: AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA REZONING CERTAIN LANDS THEREIN AS HEREIN DEFINED FROM RIA TO CI; CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. A copy of said Ordinance shall be available at the office of the City Clerk of the City of Winter Springs, Florida, for all persons desiring to examine same. All interested parties are invited to attend and be heard. THIS NOTICE is to be published in the Evening Herald and the Sentinel Star, both newspapers of general circulation in the City, one (1) time at least fifteen (15) days prior to the time of the public hearing.
