ORDINANCE NO. 154
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, REPEALING
SECTION 6-32 OF CHAPTER 6 OF THE CODE OF ORDINANCES
OF WINTER SPRINGS; ESTABLISHING NEW SECTION 6-32,
PROVIDING CONFLICTS; SEVERABILITY AND EFFECTIVE DATE.
WHEREAS, the City Council of Winter Springs deems it to
be in the public interest to repeal Section 6-32 of Chapter 6
of the Code of Ordinances of Winter Springs, because of
inconsistent language and the harsh terms thereof, and
WHEREAS to accomplish the purpose of Section 6-32 the
City Council must provide for the establishment of a new
Section 6-32 of Chapter 6.
IT IS HEREBY ORDAINED BY THE CITY OF WINTER SPRINGS, FLORID
SECTION 1. That Section 6-32 of Chapter 6 of the Code of
Ordinances as it now exists is hereby repealed.
SECTION 2. That the City of Winter Springs hereby creates
and establishes new Section 6-32 of Chapter 6 of the Code of
Ordinances of Winter Springs as follows:
Section 6-32
Hydrants shall be placed not more than seven hundred fifty
feet (750) apart in single-family residential zoning districts
or single-family sections of planned unit developments and
not more than five hundred (500) feet apart in all other
districts. Developers shall be required to place said water
systems and hydrants within developments in a loop system to
provide maximum fire fighting capability. The single-family
residence, or other structure or building in another zoning
district shall be no more than 350 feet from the nearest hydrant
said distance being measured along the road right-of-way or no
more than 350 feet from the edge of the right-of-way if the
residence sets back away from the road. No building permit shall
be issued when the specifications of this section have not been
met. Provided, however, the above restrictions shall not apply
to rural areas of the City where water lines are not within 750
feet of the proposed structure. In the event any provisions
of this section cause an undue hardship the owner of property
denied a building permit may petition the City Council for a
variance from the terms of this Section, and if granted may
receive a variance for undue hardship and a building permit.
SECTION 3. If any section or portion of section or
subsection of this Ordinance proves to be invalid, unlawful or
unconstitutional, it shall not be held to invalidate or impair
the validity, force or effect of any other section or portion
of section or subsection or part of this Ordinance.
SECTION 4. That all Ordinances or parts of Ordinances
in conflict herewith shall be and the same are hereby repealed.
SECTION 5. This Ordinance shall take effect immediately
and upon its passage and adoption.

TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN by the City council of the
City of Winter Springs, Florida, that said City Council will
hold a public hearing on Monday, July 23, 1977, at 7:30 p.m.
or as soon thereafter as possible to consider an Ordiance
entitled as follows:
AN ORDIANCE OF THE CITY OF WINTER SPRINGS, REPEAL-
ING SECTION 6-32 OF CHAPTER 6 OF THE CODE OF ORDINANCES
OF WINTER SPRINGS; ESTABLISHING NEW SECTION 6-32; PRO
VIDING CONFLICTS; SEVERABILITY AND EFFECTIVE DAATE.
A copy of said Ordinance shall be available at the
office of the City Clerk of the City of Winter Springs. Florida,
for all persons desiring to examine same.
All interested parties are invited to attend and be
heard.
THIS NOTICE is to be published in the Evening Herald and
the Sentinel Star, both newspapers of general circulation in the
City, one (1) time at least fifteen (15) days prior to the
time of the public hearing.
