ORDINANCE NO. 138
AN ORDINANCE OF THE CITY OF WINTER SPRINGS,
FLORIDA, TO EXTEND ITS TERRITORIAL AND
MUNICIPAL LIMITS TO ANNEX AND REDEFINE THE
BOUNDARY LINES OF THE MUNICIPALITY TO INCLUDE
THE HEREINAFTER DESCRIBED LANDS SITUATE AND
BEING IN SEMINOLE COUNTY, FLORIDA PURSUANT
TO FLORIDA STATUTES 171.044; PROVIDING ZONING
FOR THE SUBJECT PROPERTY; PROVIDING FOR THE
AMENDMENT OF THE OFFICIAL ZONING MAP; PROVIDING
DIRECTIONS TO THE CITY CLERK; SEVERABILITY AND
EFFECTIVE DATE.
WHEREAS, Winter Springs Development Corporation,
corporation, has petitioned the City Council of the City of
Winter Springs, Florida to annex the property described as follow
Begin at Southeast corner of Lot 147, Block "D";
D.R. Mitchell's survey of Moses E. Levy Grant,
as recorded in Plat Book l, Page 5 of the Public
Records of Seminole County, Florida, said corner
also being the Southwest corner of Gardena Farms
as recorded in Plat Book 6, Pages 23 and 24, Public
Records of Seminole County, Florida; Run thence
N. 85o05'45" W along the South line of aforesaid
Lot 147, Block "D", D.R. ,:Mitchell's Survey of
the Moses E.Levy GraJ;lk' 924.50 ft; thence N 040
57'42" E. 300.00 ft;thence S. 85o05'45" E. 924.50
ft. to a point on the East line of said Lot 147
and the West line of said Gardena Farms; thence
run S. 04o57'42" W along said line 300.00 ft. to
the point of beginning. Containing therein 6.36
acres more or less,
WHEREAS, the Charter of the City of Winter Springs,
Florida provides for the annexation of property into the corporate
limits when enacted by an Ordinance of the said City, and pursuant
to a petition of the land owners, and
WHEREAS, Florida Statute 171.044 of the General Laws of
Florida provides that a municipal corporation may annex property
into its corporate limits, upon the voluntary petition of the
owners, by passing and adopting a non-emergency ordinance to
annex said property, and
WHEREAS, the City Council of the City of Winter Springs,
Florida is desirous of annexing and redefining the boundary lines
of the municipality to include the subject property pursuant to
the authority contained in the City Charter of the City of Winter
Springs, Florida and Florida Statute 171.044 General Laws of
Florida.
NOW THEREFORE, THE CITY OF WINTER SPRINGS, HEREBY ORDAINS:
Section (1) That the City of Winter Springs, Florida does
herewith and hereby annex and redefine the boundary line of the
municipality of the City of Winter Springs by including those

contiguous lands lying in Seminole County, Florida, and more
particularly described as follows:
Begin at Southeast corner of Lot l47, Block "D",
D.R. Mitchell's Survey of Moses E. Levy Grant,
as recorded in Plat Book l, Page 5, of the Public
Records of Seminole County, Florida, said corner
also being the Southwest corner of Gardena Farms
as recorded in Plat Book 6, pages 23 and 24, Public
Records of Seminole County, Florida; Run thence
N 85o05'45" W. along the South line of aforesaid
Lot 147, Block "D", D.R. Mitchell's Survey of
the Moses E. Levy Grant, 924.50 feet; thence N.
04o57'42" E. 300.00 ft; thence S. 85o05'45" E.
924.50 ft. to a point on the East line of said
Lot 147 and the West line of said Gardena Farms;
thence run S. 04o57'42" W. along said line 300.00
ft. to the point of beginning. Containing there-
in 6.36 acres more or less,
Section (2) That the City Council of the City of Winter
Springs has determined that a zoning classification of Planned
Unit Development would be compatible with the surrounding propert
within the City, and with the passage of this Ordinance, the
City Council does hereby amend the Official Zoning Map of the
cipal limits of the City of Winter Springs, Florida, to include
the subject property with the above described designated zoning
classification and hereby make this property a part of the
Planned Unit Development called Tuscawilla.
Section (3) That upon passage and adoption of this Ordi-
nance, the City Clerk is hereby directed to file a certified copy
of this Ordinance with the Clerk of the Circuit Court, In and For
Seminole County, Florida, and to file a certified copy with the
Department of State of the State of Florida.
Section (4) If any section or portion of a section or
subsection of this Ordinance proves to be invalid, unlawful or
unconstitutional, it shall not be held to invalidate or impair
the validity, force or effect of any other section or portion of
section or subsection or part of this Ordinance.
Section (5) That all Ordinances or parts of Ordinances
in conflict herewith are hereby repealed.
Section (6) This Ordinance shall take effect immediately
upon its final passage and adoption.
