ORDINANCE NO. 136
AN ORDINANCE OF THE CITY OF WINTER SPRINGS,
FLORIDA, REPEALING SECTIONS 5-2 OF ARTICLE
I AND 5-29 OF ARTICLE II OF CHAPTER 5 OF
THE CITY OF WINTER SPRINGS, FLORIDA; CREATING
AND SUBSTITUTING NEW SECTION 5-2 OF ARTICLE
I AND 5-29 OF ARTICLE II OF CHAPTER 5 OF THE
CODE OF ORDINANCES OF THE CITY OF WINTER
SPRINGS, PROVIDING AN UPDATE TO THE BUILD-
ING CODE AND PROVIDING FOR FEES AND PROCE-
DURES FOR SETTING FEES, PROVIDING FOR CON-
FLICTS, SEVERABILITY AND EFFECTIVE DATE.
WHEREAS, the Southern Standard Building Code as adopted
in Section 5-2 of Article I of Chapter 5 of the Code of Ordinances
of the City of Winter Springs, is outdated and needs to be revise
and
WHEREAS, the City Council deems it to be in the best
interest of the citizens of Winter Springs, and in order to
promote the general welfare, safety and health, to repeal Section
5-2 of Article I of Chapter 5 of the Code of Ordinances of the
City of Winter Springs, Florida, and replace said Section with a
new Section 5-2; and
WHEREAS, in order to completely update and revise Section
5-2, Section 5-29 of Article II of Chapter 5 of the Code of Ordin-
ances of the City of Winter Springs, Florida, be repealed, and a
new Section 5-29, passed to implement the Buidling Code as adopted
in new Section 5-2;
NOW THEREFORE, the City of Winter Springs, Florida here-
by ordains:
Section 1. That Sections 5-2 of Article I and Section
5-29 of Article II, of Chapter 5 of the Code of Ordinances are
and the same hereby repealed.
Section 2. That new Section 5-2 of Article I of Chapter
5 of the Code of Ordinances of the City of Winter Springs, is here
by passed and adopted as follows:
CODE SECTION 5-2: STANDARD BUILDING CODE.
There is hereby adopted by the City, the Standard Buildin
Code as promulgated by the Southern Standard Building Code Congress
International, Inc., as it exists on the date of the adoption of
this Ordinance, or as it may be amended., renumbered or renamed in
the future, as the sole and exclusive minimum standard for build-
ing and construction within the municipal limits of the City
of Winter Springs, Florida. The provisions of the Standard
Building Code shall govern all matters contained therein, except
when in conflict with the provisions of this Chapter or other
Ordinances of the City.
Section 3. That a new section 5-29 of Article II of
Chapter 5 of the Code of Ordinances of the City of Winter Springs
is hereby passed and adopted as follows:
CODE SECTION 5-29. INSPECTION AND PERMIT FEES.
On all building, structures or alterations requiring a
building permit, a fee shall be paid in accordance with the
following schedule:
a) Permit Fees.
1) Where the valuations of the labor and materials
to perform the work does not exceed $100.00, no fee shall be
required, unless an inspection is necessary, in which case there
shall be a $5.00 fee for each inspection.
2) Building permit fees for construction, alterations,
or repairs, where there is an evaluation of labor and materials
to perform the work, which exceeds $100.00, there shall be a fee
of $3.00 per thousand. Provided however, a minimum fee of $10.00
shall be applied in all cases requiring the issuance of a build-
ing permit. The fee may be doubled if construction is commenced
before a permit is obtained.
3) Fees for Building, Mechanical, Electrical and Plumb-
ing permits shall be set by Resolutions of the City Council adopted
pursuant to the authority of this Section upon recommendations of
the City Building Official.
4) For the moving of any building or structure, the fee
shall be $10.00 and in addition, the mover must post bonds in
amounts required by the City Building Official.
5) For the demolition of any building or structure, the
fee shall be $10.00.
Section 4. Conflicts.
This Ordinance shall not be construed to have the effect

TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN by the City Council of the city
of Winter Springs, Florida, that said City Council will hold a
public hearing at 7:30 p.m. or as soon thereafter as possible,
on Monday, June 14, 1976, to consider the adoption of an ordinance
by the City of Winter Springs, Florida, title of which is as
follows:
AN ORDINANCE OF THE CITY OF WINTER SPRINGS,
FLORIDA, REPEALING SECTIONS 5-2 OF ARTICLE
I AND 5-29 OF ARTICLE II OF CHAPTER 5 OF
THE CITY OF WINTER SPRINGS, FLORIDA; CREATING
AND SUBSTITUTING NEW SECTION 5-2 OF ARTICLE
I AND 5-29 OF ARTICLE II OF CHAPTER 5 OF THE
CODE OF ORDINANCES OF THE CITY OF WINTER
SPRINGS, PROVIDING AN UPDATE TO THE BUILD-
ING CODE AND PROVIDING FOR FEES AND PROCE-
DURES FOR SETTING FEES, PROVIDING FOR
CONFLICTS, SEVERABILITY AND EFFECTIVE DATE.
A copy of said ordinance shall be available at the
office of the City Clerk of the City of Winter Springs, Florida,
for all persons desiring to examine the same.
All interested parties are invited to attend and be
heard.
THIS NOTICE is to be published in the Evening Herald,
a newspaper of general circulation in said City, one time at least
15 days prior to the time of the public hearing.

of repealing any existing Ordinance concerning the subject matter
of this Ordinance, but the regulations established herein shall
be supplemental and cumulative; however, in the case of a direct
conflict with a provision or provisions of any existing Ordinance,
the provision which is more restrictive and imposes higher stand-
ards or requirements shall govern.
Section 5. Severability.
If any section, part of section, paragraph, sentence,
clause, phrase, or word of the Ordinance is, for any reason, held
or declared to be unconstitutional, inoperative, or void, such
holding of invalidity shall not affect the remaining portions of
this Ordinance and it shall be construed to have been the legis-
lative intent to pass this Ordinance without such unconstitutional
invalid, or inoperative part therein, and the remainder of this
Ordinance, after the exclusion of such part or parts, shall be
deemed to be held valid as if this Ordinance or any provisions
thereof has been enacted without such unconstitutional, invalid
or inoperative part and in the event this Ordinance or any part
thereof, shall be held inapplicable to any person, group of person,
property, kind of property, circumstances or set of circumstances
such holding shall not affect the application thereof to any
other person, property, or circumstances.
Section 6. Effective Date.
This Ordinance shall take effect immediately upon passage
and adoption.
