ORDINANCE NO. 133
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF WINTER SPRINGS, ESTABLISHING A
MECHANICAL CODE FOR CONSTRUCTION PURPOSES
WITHIN THE CITY OF WINTER SPRINGS, FLORIDA;
ADOPTING THE SOUTHERN STANDARD MECHANICAL
CODE AND THE STANDARDS SET FORTH FOR THE
CITY OF WINTER SPRINGS, FLORIDA; PROVIDING
FOR THE COLLECTION OF MECHANICAL PERMIT
FEES; SETTING FORTH THE MECHANICAL PERHIT
PROCEDURES; PROVIDING FOR THE PENALTIES
FOR THE VIOLATION OF THIS ORDINANCE, PRO-
VIDING A VALIDITY CLAUSE, AND PROVIDING
AN EFFECTIVE DATE.
THE CITY COUNCIL OF THE CITY OF WINTER SPRINGS, FLORIDA,
HEREBY ORDAINS:
Section 1. Short Title: This Ordinance shall be known
and may be cited as the Mechanical Code of the City of Winter
Springs, Florida.
Section 2. Definitions:
(1) The word "CITY" as used herein refers to the City
of Winter Springs, Florida.
(2) The words "MECHANICAL CODE" as used herein refer
to the Standard Mechanical Code and all Amendments thereto, pro-
mulgated by the Southern Standard Building Code Congress Inter-
national Inc.
(3) The words "RATE STANDARDS" as used herein refer to
the rate standards set forth by the City Council pursuant to
resolutions adopted pursuant to this Ordinance.
Section 3. The City of Winter Springs hereby adopts
the Standard Mechanical Code as it exists on the date of adoption
of this Ordinance or as it may be amended in the future, as the
sole and exclusive minimum standards for Building and Construction
within the municipal limits of the City of Winter Springs, Florida.
Section 4. Mechanical Inspection: The Building
Department for the City shall make all inspections, issue all
permits and enforce all provisions of the Standard Mechanical
,I Code within the City of Winter Springs, Florida.
Section 5. Fees: All applications for Mechanical
Permits shall be accompanied by an appropriate Mechanical Permit
Fee as set forth by the City Council pursuant to Resolutions
adopted under the authority of this Ordinance.
Section 6. Violations: Violations of this municipal
ordinance and the standards set forth herein shall be punishable
by a fine not in excess of $500.00 and/or incarceration for not
more than ninety (90) days. Each day that a violation exists
shall constitute a new and separate offense.
Section 7. Validity: It is declared to be Council's
intent that no part of this ordinance be in violation of any
constitutional rights of any person, group of persons, or circum-
stances; however, if any section, subsection, sentence, clause or
phrase of this ordinance is for any reason held to be unconstitu-
tional, such decision shall not affect the validity of the re-
maining portions of this Ordinance.
Section 8. Effective Date: This Ordinance shall be-
come effective immediately upon its passage and adoption.

NOTICE OF PUBLIC HEARING
TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY given by the City Council of the City
of Winter Springs, Florida, that said City Council will hold a
Public Hearing at 7:30 p.m., or as soon thereafter as possible
on Monday, May 10, 1976, to consider adoption of an ordinance
by the City of Winter Springs, Florida, title of which is as
follows:

CITY OF WINTER SPRINGS, ESTABLISHING A
MECHANICAL CODE FOR CONSTRUCTION PURPOSES
WITHIN THE CITY OF WINTER SPRINGS, FLORIDA;
ADOPTING THE SOUTHERN STANDARD MECHANICAL
CODE AND THE STANDARDS SET FORTH FOR THE
CITY OF WINTER SPRINGS, FLORIDA; PROVIDING
FOR THE COLLECTION OF MECHANICAL PERMIT
FEES; SETTING FORTH THE MECHANICAL PERMIT
PROCEDURES; PROVIDING FOR THE PENALTIES
FOR THE VIOLATION OF THIS ORDINANCE, PRO-
VIDING A VALIDITY CLAUSE, AND PROVIDING
AN EFFECTIVE DATE.
A copy of said Ordinance shall be available at the
Office of the City Clerk of the City of Winter Springs, Florida,
for all persons desiring to examine same.
ALL INTERESTED PARTIES ARE INVITED to attend and be
heard.
THIS NOTICE is to be published in The Evening Herald,
a newspaper of general circulation in said City, one (1) time at
least fifteen (15) days prior to the time of the Public Hearing.
