ORDINANCE NO.122
AN ORDINANCE OF THE CITY OF WINTER SPRINGS,
FLORIDA, AMENDING SECTION 6-1, ARTICLE I,
CHAPTER 6, CODE OF ORDINANCES, PROVIDING
FOR DELETION OF PHRASE "POLICE DEPARTMENT"
THEREFROM AND INSERTING IN ITS STEAD THE
PHRASE "FIRE DEPARTMENT"; ADDING ARTICLE
III, CHAPTER 6, CODE OF ORDlNANCES, TO BE
CAPTIONED ";FIRE HYDRANTS", PROVIDING FOR
RESPONSIBILITY, PLACEMENT AND HEIGHT
REQUIREMENTS OF FIRE HYDRANTS WITHIN THE
CITY LIMITS; ESTABLISHING SPECIFIC REQUIRE-
MENTS THEREFOR; PROVIDING THAT WATER
SERVICING UTILITIES SHALL PROVIDE WATER
FOR FIRE PROTECTION AT NO COST TO THE CITY;
REPEALING ALL ORDINANCES OR PARTS OF ORDI-
NANCES IN CONFLICT HEREWITH; SEVERABILITY
AND EFFECTIVE DATE.
WHEREAS, the City Council of the City of Winter Springs,
Florida, desires to change the responsibility for controlling
outside burning of trash, underbrush, felled trees or any other
material within the city limits from the Police Department to
the Fire Department, and
WHEREAS, the City of Winter Springs, Florida, desires
to regulate and control the responsibility, placement and height
standards for fire hydrants within the city limits for the health,
safety and welfare of the residents within said city, and
WHEREAS, the City of Winter Springs, Florida, desires to
require any water servicing utility within the city to provide
water for fire protection at no cost to the city.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WINTER
SPRINGS, FLORIDA, HEREBY ORDAINS:
1. ALL SECTIONS OF CHAPTER 6, CODE OF ORDINANCES, CITY
OF WINTER SPRINGS, FLORIDA, EXCEPT SECTION 6-1, INCORPORATED
HEREIN - All Sections of Chapter 6, Code of Ordinances, City of
Winter Springs, Florida, as heretofore passed by the City
Council of the City of Winter Springs, Florida, are hereby
ratified, and incorporated herein as if set forth herein, except
Section 6-1 thereof.
2. AMENDED SECTION 6-1, CHAPTER 6, CODE OF ORDINANCES,
CITY OF WINTER SPRINGS, FLORIDA - Section 6-1, Article I, Chapter
6, Code of Ordinances, City of Winter Springs, Florida, is hereby
amended by deleting the phrase "police department" and inserted
in its stead the phrase "fire department", and shall read as
follows:
"No person shall burn trash, underbrush,
felled trees or any other material within the
city limits without the express permission of
the fire department as to the size, location
and duration of each burning, and without cons-
tant supervision of each burning until the last
spark of fire has been extinguished."
3. ARTICLE III, CHAPTER 6, CODE OF ORDINANCES, CITY
OF WINTER SPRINGS, FLORIDA - Article III, titled "Fire
Hydrants" shall be added to Chapter 6, Code of Ordinances,
City of Winter Springs, Florida, and shall read as follows:
"ARTICLE III. FIRE HYDRANTS
Section 6-31. Fire Hydrant Responsibilities.
(a) Land developers developing subdivisions shall
provide fire hydrants at their own expense at the
time of development, as outlined in Section 14-123
of this Code.
(b) The water utility servicing the hydrants with
water shall be responsible for all service mains
and connections to the base of the hydrants and
all maintenance or replacement thereof. Upon
acceptance of the fire hydrants by the city, the
city shall assume ownership and maintenance respon-
sibility for the hydrants only.
(c) Approval of hydrant placement and their
acceptance by the city shall be the responsibility
of the Fire Chief of the Winter Springs Fire Depart-
ment.
Section 6-32. , Hydrant Placement. Hydrants
shall be placed not more than seven hundred fifty
(750) feet apart in single family residential
zoning districts or single family sections of
planned unit developments and not more than five
hundred (500) feet apart in all other districts.
No single family residence shall be more than five
hundred (500) feet along the street or roadway edge
from the nearest hydrant. In all other districts the
nearest hydrant shall be not less than three hundred
fifty (350) feet from the street or roadway edge.
No building permit shall be issued when the speci-
fications of this Section have not been met.
Section 6-33. Hydrants Positioning.
(a) Hydrants shall be positioned so that the 4 1/2"
large open.ing in the hydrant faces the nearest
street in order that the fire pumps may have con-
,venient access thereto .
(b) Approval of hydrant positioning and their
acceptance shall be the responsibility of the
Fire Chief of The Winter Springs Fire Department.
Section 6-34. Obstruction of Fire Hydrants.
No obstructing material, sign, fence, shrub, tree,
wall, or other obstacle shall be within six (6)
feet from the rear of a hydrant (for purposes of
this Section, "side shall mean either side of the
hydrant that has the small 2 1/2" openings and
"rear" shall mean the side of the hydrant that has
no openings). No obstruction shall be placed or
grown in front of a fire hydrant (for purposes of
this Section, "front" shall be defined as being
the side of the hydrant which contains the large
opening).
Section 6-35. Hydrant Height. The height of
all fire hydrants shall be such that the finished
land grade provides at least eighteen (18) inches,
but not more than thirty-six (36) inches from the
center of the 2 1/2" small openings on the hydrant
to the ground cover and at least fifteen (15) inches,
but not more than thirty-three (33) inches from the
center of the 4 1/2" large opening on the hydrant
to the ground cover.
Section 6- 36. Water Control Valve. Each
hydrant shall have its own underground on-off
control valve immediately adjacent to the hydrant.
Section 6-37. 'Provision of Water. As a
condition for providing water service within the
city, the water servicing utility shall provide
water for fire protection at no cost to the city."
4. This Ordinance shall not be construed to have the
effect of repealing any existing Ordinance concerning the subject
matter of this Ordinance, but the regulations established herein
shall be supplemental and cumulative; however, in case of a
direct conflict with a provision or provisions of any existing
Ordinance, the provision which is more restrictive and imposes
higher standards or requirements shall govern.
5. If any section, part of a section, paragraph,
sentence, clause, phrase, or word of this Ordinance is, for any
reason, held or declared to be unconstitutional, inoperative,
or void, such holding of invalidity shall not affect the remainin
portions of this Ordinance, and it shall be construed to have
been the legislative intent to pass this Ordinance without such
unconstitutional, invalid or inoperative part therein and the
remainder of this Ordinance, after the exclusion of such part
or parts, shall be deemed to be held valid as if such part or
parts had not been included therein, or if this Ordinance, or any
provisions hereof, shall be held inapplicable to any person,
group of persons, property, kind of property, circumstances, or
set of circumstances, such holding shall not affect the applica-
bility hereof to any person, property or circumstance.
6. This Ordinance shall take effect immediately upon
passage and adoption.

TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN by the City Council of the City
of Winter Springs, Florida, that said Council will hold a public
hearing at 7:30 p.m., or as soon thereafter as possible, on
Monday, July 14, 1975, to consider the adoption of an ordinance
by the City of Winter Springs, Florida, title of which is as
follows:

THIS NOTICE is to be published in THE EVENING HERALD, a
newspaper of general circulation in said City, one (1) time at
least 15 days prior to the time of the public hearing.

Proposed Ordinance
CHAPI'ER 6, FIRE PREVENTION AND PROTECTION, CITY CODE
Section 6-1. Change the term "Police Department" to "fixe Chief or his
designee."
Add ARTICLE III, FIRE HYDRANTS, as follows
Section 6-31. Fire Hydrant Res~onsibilities.
Land developers developing subdivisions shall provide fixe hydrants at
theix own expense at the time of development, as outlined in section 14-123
of this code.
The Utility servicing the hydrants with water shall be responsible for
all service mains and connections to the base of the hydrants and all
maintenance and/or replacement thereof. Upon acceptance of the fire
hydrants by the City, the City shall assume ownership and maintenance
responsibility for the hydrants only.
Approval ef;hydrant placement and their acceptance by the City shall
be the responsibility of the Fixe Chief.
Section 6-32. Hydrant Placement. Hydrants shall be placed not more than
750 feet apart in single family residential districts and not more than
500 feet apart in all other districts. Further, no single family residende
shall be more than 500 feet 8.long.'the;;street ~e',from},the nearest bydrant.
In all other districts this street distance shall not exceed 350 feet.
A building permit shall not be issued in instances where this distance
criteria is not met.
Section 6-33. Hydrant Positioning. Hydrants shall be positioned so that
the large (41- inch) opening faces the dixection it is most likely to be
used by a fire pumper, l.e., facing the street or other dixection that
will provide the most convenient access to a normal positioning of a fire
pumper. The Fixe Chief shall approve the positioning of any hydrant not
facing the adjacent street.
Section 6-34. Obstruction of Fire Hydrants. No obstructing item, sign,
fence, shrub, tree, wall, or other obstacle shall be within six feet of
either side or three feet of the rear of a hydrant. (Side meaning either
side of the hydrant that has the small 2-t inch openi~ located. Rear
meaning the side of the hydrant that has no openings.) No obstruction
shall be placed or grown in front of a fire hydrant. (Front defined as
being the side of the hydrant which contains the large opening.)
Section 6-35. Hydrant Hei~ht. The height of all fire hydrants shall be
such that the finished land grade provides at least 18 inches, but not
"more than 36 inches, from the center of the 2i inch small openings to the
ground cover; and at least 15 inches, but not more than 33 inches, from the
center of the ~ inch large opening to the ground cover. ,
Section 6-36. ,Tater Control Valve. Each hydrant shall have its own
underground water control (turn on/off) valve immediately adjacent to
the hydrant.

Add ARTICLE IV, PROVISION OF WATER FOR FIRE PREVENTION AND PROTECTION, as
follows
Section 6-40. Provision of Water. As a part of providing water service
within the City of Winter Springs, a water servicing utility shall provide
water for fire prevention and protection use at no cost to the City.
Note for Council Members: I plan to introduce this as an ordinanc~ to
provide needed legislation if we are to maintain adequate fire protection.
