HomeMy WebLinkAboutOrdinance 85 Election ORDINANCE NO. 85 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, REPEALING ALL PROPERTY OWNERSHIP REQUIREMENTS, SPECIFICALLY ALLOWING ALL CITIZENS TO BE ELIGIBLE FOR APPOINTMENTS OR ELECTIONS AND ALLOWING ALL CITIZENS TO VOTE IN ALL ELECTIONS, REPEALING CONFLICTS; AND EFFECTIVE DATE. WHEREAS, several ordinances of the City of Winter Springs, Florida, contain a requirement that an individual own property prior to serving in an appointive or elective capacity, and WHEREAS, this requirement has been subject to close judicial scrunity for reason that it may be contrary to the Constitution of the United States of America, and of the State of Florida, and WHEREAS, the City Council of the City of Winter Srpings, Florida, considers that such a requirement is no longer a valid consideration in holding an appointive or elective office or exercising voting privileges within the City of Winter Springs, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WINTER SPRINGS, FLORIDA HEREBY ORDAINS: 1. That all requirements that an individual be a "FREEHOLDER" to be appointed or elected to a position of public responsibility or office, or to vote in any election held by the City of Winter Springs, Florida, is hereby declared to be null and void. 2. That all citizens living within the jurisdictional limits of the City of Winter Springs, Florida, are hereby de- clared to be eligible to serve in any appointive or elective position and are specifically allowed to vote in any election in which they are otherwise eligible to participate. 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. 4. This Ordinance shall take effect immediately upon its final passage and adoption.
