HomeMy WebLinkAboutOrdinance 82 Annexation ORDINANCE NO. 82 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, TO EXTEND ITS TERRITORIAL AND MUNICIPAL LIMITS TO ANNEX LANDS SITUATE AND BEING IN SEMINOLE COUNTY, FLORIDA, AND DE- SCRIBED AS FOLLOWS: BEGINNING AT THE NW CORNER OF LOT 16, BLOCK D OF MITCHELL'S SURVEY OF LEVY GRANT AS RECORDED IN PB 1, PG 5 OF THE PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA RUN NORTH 89o13' EAST ALONG THE NORTHERLY LINE OF SAID LOT 16, 910.1 FT TO THE NE CORNER OF SAID LOT 16, RUN THENCE SOUTH 5o WEST ALONG THE EASTERLY LINE OF SAID LOT 16, 978.33 FT. RUN THENCE 89ol3'WEST 910.1 FT. TO A POINT ON THE WESTERLY LINE OF SAID LOT 16, RUN THENCE NORTH 50 EAST 978.33 FT. TO A POINT OF BEGINNING, CON- TAINING 20 ACRES MORE OR LESS; WHICH SAID LANDS ARE LYING CONTIGUOUS TO THE PRESENT BOUNDARIES OF THE CITY OF WINTER SPRINGS, FLORIDA, AND WITH- IN SEMINOLE COUNTY; ANNEXING SAME TO THE CITY OF WINTER SPRINGS, FLORIDA; REDEFINING THE CORPORATE LIMITS OF THE CITY OF WINTER SPRINGS TO INCLUDE SAID LANDS WITHIN THE MUNICIPAL LIMITS OF THE CITY OF WINTER SPRINGS; TO INCLUDE THE ANNEXATIONS HEREIN ON THE WINTER SPRINGS MAP; SEVERABILITY; EFFECTIVE DATE; AND CONFLICTS. THE CITY COUNCIL OF THE CITY OF WINTER SPRINGS, FLORIDA HEREBY ORDAINS: WHEREAS, MR. MORTON SILVER, Trustee, has petitioned the City Council of the City of Winter Springs, Florida, to annex the property described as follows: Beginning at the NW corner of Lot 16, Block D of MITCHELL'S SURVEY OF LEVY GRANT, as recorded in Plat Book 1, Page 5 of the Public Records of Seminole County, Florida, run North 89o13' East along the Northerly line of said Lot 16, 910.1 ft. to the NE corner of said Lot 16, run thence South 50 West along the Easterly line of said Lot 16, 978.33 ft. run thence 89o13' West 910.1 ft. to a point on the Westerly line of said Lot 16, run thence North 50 East 978.33 ft. to a point of beginning, containing 20 acres more or less, and WHEREAS, the property described above lies contiguous to the present boundaries of the City of Winter Springs, Florida, and WHEREAS, the Charter of the City of Winter Springs, Florida, provides for the annexation of property to the corporate limits when enacted by an ordinance of the said City, and WHEREAS, the City Council of the City of Winter Springs, Florida, is desirous of annexing the subject property pursuant to the authority contained in the City Charter of the City of Winter Springs, Florida, WHEREAS, MR. MORTON SILVER, Trustee, in his petition to the City Council of the City of Winter Springs, to annex the subject property, also included a request for the zoining of subject property to be classed as R-3, and NOW, THEREFORE, THE CITY OF WINTER SPRINGS, FLORIDA HEREBY ORDAINS: Section 1. That the City of Winter Springs Florida, does herewith and hereby annex those certain lands lying in Seminole County, Florida, and more particularly described as follows: Beginning at the NW corner of Lot 16, Block D of MITCHELL'S SURVEY OF LEVY GRANT, as recorded in Plat Book 1, Page 5 of the Public Records of Seminole County, Florida, run North 89o131 East along the Northerly line of said Lot 16, 910.1 ft. to the NE corner of said Lot 16, run thence South 50 West along the Easterly line of said Lot 16, 978.33 ft. run thence 89o131 West 910.1 ft. to a point on the Westerly line of said Lot 16, run thence North 50 East 978.33 ft. to a point of beginning, containing 20 acres more or less, Section 2. That the City Council of the City of Winter Springs, Florida, amend the Map of the municipal limits of the City of Winter Springs, Florida, to include the subject property and that the subject property be zoned R-3 on the official zoning map. -2- Section 3. If any section or portion of a section or subsection of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other section or portion of a section or subsection or part of this Ordinance. Section 4. Effective Date: This Ordinance shall take effect immediately upon its final passage and adoption. Section 5. Conflicts: That all ordinances or parts of ordinances in conflict herewith are hereby repealed. PASSED AND ADOPTED this 6th day of November, 1972.
