HomeMy WebLinkAboutOrdinance 77 Election ORDINANCE NO. 77 AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, FOR THE REPEALING OF A SECTION OF THE CITY CHARTER; PROVIDING FOR AN ELECTION OF THE QUALIFIED VOTERS OF THE CITY OF WINTER SPRINGS, FLORIDA; PROVIDING A FORM FOR THE BALLOT TO BE USED IN THE REFERENDUM ELECTION AND PROVIDING AN EFFECTIVE DATE WHEREAS, the Legislature of the State of Florida, passed House Bill No. 3390, which provides for the municipal government of the City of Winter Springs, Florida, and WHEREAS, the Charter of the City of Winter Springs, Florida, contains a provision for closed sessions of the City Council in certain instances, and WHEREAS, closed sessions of the City of Winter Springs, Florida, City Council are contrary to the general laws of the State of Florida, and WHEREAS, the City Council of the City of Winter Springs, Florida, desires to remove this Section from the Charter of the City of Winter Springs, Florida, pursuant to the authority granted in Florida Statute 166.17(197l). NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WINTER SPRINGS, FLORIDA: Section 1. Section 4.13. Procedure of the Charter of the City of Winter Springs, Florida, shall read as follows: "(a) Meetings. The council shall meet regularly at least once every month at such times and places as the council may prescribe by rule. Special meetings may be held on the call of the mayor or three or more members and, whenever practicable, upon no less than twelve hours. notice to each member. All meetings shall be public." Section 2. All parts, portions or other sentences presently contained in Section 4.13 of the City Charter of the City of Winter Springs, Florida, are hereby specifically repealed. Section 3. The qualified voters of the City of Winter Springs, Florida, shall vote to ratify this Ordinance in the first primary election to be held on September 1972. Provided a majority of the qualified voters of the City of Winter Springs, Florida, vote in said election for adoption of this Amendment to the City Charter, then the provisions of this Ordinance shall amend the Charter of the City of Winter Springs, Florida, and shall be in full force and effect on, from and after the filing of the revised Charter with the Department of State. Section 4. The Ballot to be used in the referendum election shall be in the following form: "Section 4.13 Procedure of the City Charter of the City of Winter Springs, Florida, be amended to require all meetings of the City Council of the City of Winter Springs, Florida, to be open to the public. For adoption Against adoption " Section 5. This Ordinance shall become effective immediately upon its passage and adoption by the City Council of the City of Winter Springs, Florida.
