ORDINANCE NO. 66
AN ORDINANCE OF THE VILLAGE OF NORTH ORLANDO,
FLORIDA, AMENDING ORDINANCE NO. 50, PERTAINING
TO SUBDIVISIONS; ESTABLISHING THE USE OF
SEPTIC TANKS WITHIN SUBDIVISIONS; REQUIRING
WRITTEN APPROVAL BY THE APPROPRIATE STATE
HEALTH OFFICER; OUTLINING SEPTIC TANK LOCATIONS;
REQUIRING THE INSTALLATION OF WATER AND SEWER
TRUNK LINES; REQUIRING THE INSTALLATION OF
STREET LIGHTS AND TRAFFIC SIGNS; REQUIRING
FIRE HYDRANTS WITHIN SUBDIVISIONS; ESTABLISHING
FENCE REQUIREMENTS; REPEALING ALL ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT HEREWITH;
SEVERABILITY; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF NORTH ORLANDO, FLORIDA:
SECTION I. Purpose. The purpose of this Ordinance
is to amend Ordinance No. 50 relating to subdivisions located
or to be located within the Village of North Orlando, Florida,
and the standards, conditions and requirements set forth
herein shall pertain to all subdivisions located or to be
located within the Village of North Orlando, Florida.
SECTION II. Regulations of the Use of Septic Tanks.
The developer of any subdivision within the municipal limits
of the Village of North Orlando, Florida, may utilize septic
tanks after approval of an appropriate resolution by the Village
Council of the Village of North Orlando, Florida, subject to
the following terms and conditions:
(1) A written request for such permission will be
submitted to the Village Council at the same time that the
plat for the said subdivision is forwarded to the Village
Council for approval.
(2) A written statement shall be submitted at the
time of the request from the Florida State Board of Health,
or appropriate officer thereof, approving the use of septic
tanks in the proposed subdivision.
(3) A subdivision plat of less than twenty acres
shall require a minimum of twenty (20) thousand square feet
per lot before the Village Council may authorize the use of
septic tanks.
(4) A subdivision plat of in excess of twenty acres
shall consist of a minimum of forty-three thousand five hundred
sixty (43,560) square feet per lot before the Village Council
may authorize the use of septic tanks.
(5) All septic tanks shall be located thirty-five
(35) feet from both front and side lot lines.
SECTION III. Requirements for Water and Sewer Lines.
It shall be the responsibility of the subdivision developer
to have installed a water and sewer trunk line system within
each subdivision prior to the sale of any lots located therein.
In no event shall the Village of North Orlando,
Florida, be required to pay the cost of the installation of
said water and sewer tank line systems.
SECTION IV. Street lights and traffic signs. The
plat of each proposed subdivision shall include the location
of appropriate street lights and traffic signs thereon. The
Village Council shall approve the location and installation of
said street lights and traffic signs at the time of the approval
of the plat of the said subdivision.
The subdivision developer shall install and be
responsible for the installation of the said street lights and
traffic signs at no cost to the Village of North Orlando,

Florida, and the Village shall accept the street lights and
traffic signs for maintenance at the same time that the streets
and other improvements located within the said subdivisions
are accepted by the Village for maintenance.
SECTION V. Fire Hydrants. The plat of any sub-
division submitted for approval by the Village Council shall
require fire hydrants located at least each seven hundred fifty
(750) feet measured along the street right-of-way within the
said plat; the fire hydrants shall be installed by the sub-
division developer at no cost to the Village of North Orlando,
Florida.
SECTION VI. Street Construction. When Type II
asphalt concrete is used in any street construction, it shall
meet a Hubbard Stability Test of 2,000 or a Marshall Stability
Test of 800.
SECTION VII. Drainage Ditch Fences. Whenever a
building permit is issued for a lot which borders on a drainage
ditch, the builder shall be required to place a four foot chain
link fence with top rail and bottom tension wire or equivalent
thereof, along the said lot bordering the drainage ditch.
SECTION VIII. All Ordinances or parts of Ordinances
in conflict herewith shall be, and the same are hereby repealed.
SECTION IX. If any Section or portion of Section or
Subsections of this Ordinance proves to be invalid, unlawful,
or undonstitutional, it shall not be held to invalidate or
impair the validity, force, or effect of any other Section of
portion of a Section or Subsection or part of this Ordinance.

SECTION X. This Ordinance shall take effect
immediately upon its final passage and adoption.
