HomeMy WebLinkAboutOrdinance 47 Sale/Use Alcohol ORDINANCE NO. 47 AN ORDINANCE OF THE VILLAGE OF NORTH ORLANDO, FLORIDA, SETTING REQUIREMENTS FOR THE SALE AND USE OF ALCOHOLIC BEV- ERAGES IN THE VILLAGE; REQUIRING A LICENSE FOR THE SALE OF SAID BEVERAGES; REGULATING LICENSES; PROHIBITING SALE IN CERTAIN LOCATIONS AND AT CERTAIN TIMES; REQUIRING STATE AND FEDERAL LIQUOR STAMPS; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH ORLANDO, FLORIDA: SECTION 1. Compliance with state law. It shall be unlawful for any person to manufacture, sell, barter or exchange any alcoholic or intoxicating liquors or beverages whether spirituous, venous, or malt in this Village, except as permitted by the Laws of the State of Florida. SECTION 2. Same-Required for possession, custody, control. it shall be unlawful for any person to have uin his possession, custody or control in the Village any alcoholic or intoxicating liquors or beverages, except as it be permitted by the Laws of the State of Florida. SECTION 3. Licenses required. No person shall engage in, manage, operate or cause to be operated the business of vendor, without first procuring a Village license therefor as herein provided. SECTION 4. Same-Tax. There is hereby imposed and levied upon vendors of alcoholic beverages in the Village an annual license tax in the sum of fifty percent of the amount of the state and county license tax imposed upon such vendors by state law. SECTION 5. Same-Issued annually; nontransferable; exception. No license shall be issued except annual licenses, which shall be paid for on or before the first day of the tax year of the Village and shall expire the last day of the tax year provided that any person beginning business on or after the expiration of six months of any tax year may procure a license expiring the last day of the tax year on the payment of one-half of the annual license tax. No license or licenses issued under the provisions of this chapter shall be transferable or assignable from one person to another nor from one location to another except upon the ex- press permission of the Village legislative body. SECTION 6. Sale-Prohibited near church or school. No liquor, beer or wine shall be sold within two hun- dred feet in an airline from any church, public or private school operated for the instruction of minors in the common branches of learning measured from building to building at their closest points, except such places of business as are already established. SECTION 7. Same-Prohibited during designated time. It shall be unlawful for any person in the Village to sell, barter, exchange or in anywise deal in alcoholic beverages containing more than one percent of alcohol by weight between the hours of 5 o'clock a.m. and 7 o'clock a.m. of the same day. SECTION 8. Waiver of rights of search. All licenses, by their acceptance of their license agree - 2 - - that their places of business, during business hours, shall always be subject to be inspected and searched without search warrant by police officers of the Village. SECTION 9. Stamps and labels required. No liquor, wine, beer, ale or intoxicating beverages shall be sold by any person under this chapter where the con- tainer thereof does not have and bear the stamps, marks and labels required by the laws of the State of Florida and of the United States relating to intoxicating beverages. SECTION 10. Effective Date. This Ordinance shall become effective immediately upon its passage and adoption by the Village Council of the Village of North Orlando, Florida.
