HomeMy WebLinkAboutOrdinance 43 Stray Dogs ORDINANCE NO. 43 AN ORDINANCE OF THE VILLAGE OF NORTH ORLANDO, FLORIDA, AMENDING ORDINANCE NO. 16 OF THE VILLAGE OF NORTH ORLANDO, FLORIDA, PASSED AND ADOPTED MAY 3, 1960; PROVIDING FOR THE RETENTION OF STRAY DOGS COLLECTED WITHIN THE CORPORATE LIMITS OF THE VILLAGE FOR A PERIOD OF 3 DAYS; REPEALING ALL ORDINANCES OR POINTS OF ORDINANCES IN CONFLICT HEREWITH; PRO- VIDING EFFECTIVE DATE. WHEREAS, the Village Council of the Village of North Orlando, has heretofore passed on May 3, 1960, Ordinance No. 16, Pertaining to the Collection and Retention of Stray Dogs Found Within the Corporate Limits of the Village; and WHEREAS, it has been determined that said Ordinance should be amended with relationship to the period of time such stray dogs should be retained prior to disposal; and WHEREAS, such legislation is needed in order that the costs of such collection and retention be kept reasonable; NOW THEREFORE BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH ORLANDO, FLORIDA: SECTION 1 - ALL SECTIONS OF ORDINANCE NO. 16 EXCEPT SECTIONS 15 AND 16 INCORPORATED HEREIN - All Sections of Ordinance No. 16 as heretofore passed by the Village Council of the Village of North Orlando on May 3, 1960, are hereby ratified and incor- porated herein as if set forth herein, except Section 15 and Section 16 thereof. SECTION 2 - AMENDED ORDINANCE SECTION 15 - Section 15 of the Amended Ordinance No. 16 shall read as follows: "That the Owner of any impounded dog may reclaim and repossess said dog at any time within three (3) days after the impounding and upon payment of a fee of $2.50 per day for the care and maintenance of the dog while impounded, and in the case of an unlicensed dog, upon obtaining a license for such dog as herein provided for." SECTION 3 - AMENDED ORDINANCE SECTION 16 - Section 16 of the Amended Ordinance No. 16 shall read as follows: "That if the Owner of any dog, licensed or unlicensed, fails to reclaim and repossess such dog within three (3) days from the date of impounding, the Chief of Police may cause said dog to be sold or otherwise disposed of, and in the event of sale, the proceeds of the sale shall first be applied to defray the cost of care and maintenance of the dog while impounded, and the balance then remaining shall be paid to the Owner of the dog if known, and if the said Owner is unknown, the said balance shall be paid into the treasury of the Village of North Orlando and credited to the General Fund, the same as all other fees and charges collected under this ordinance - and which fees, charges, and proceeds of sales are hereby appropriated to defray the cost of license tags, clerical costs, and the care of impounded dogs which are not claimed and repossessed by the Owner." SECTION 4 - CONFLICTS - All Ordinances or parts of Ordinances in conflict herewith be and the same are hereby re- pealed. SECTION 5 - EFFECTIVE DATE - This Ordinance shall take affect immediately upon its passage. -2- ADOPTED at a regular meeting of the Village Council of the Village of North Orlando, Florida, this 11th day of September, A.
