BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH ORIANDO, FWRIDA: SECTION 1. There is hereby created a Village Planning and Zoning Board to be composed of five members, each of which shall be a resident of the Village of North Orlando. SECTION 2. The members of said Board shall be appointed by the Village Council. The term of office shall run from the second Friday in July in the year in which the appointment is made. In making the first appointments under this ordinance" two members shall serve for one year, and three for t'tfO years. Thereafter, each person appointed shall serve for a term of two years, or until his successor is appointed and qualified. Members shall be subject to removal by the Council for failure to perform their duties or take an active part in the Board I s duties, or for other misconduct in office. Vacancies on the Board IDaJ be filled bt the Council at,. any time for the unexpired term. SECTION 3. The Board shall organize and select one of its members Chairman at a meeting to be called by the Village Clerk within .30 days following the effective date of this ordinance. Thereafter, the Board shall hold regular meetings, at least once every month and more often if the members deem it necessary. The Chairman may call a meeting at any time upon his own volition, or he shall call a meeting when he is requested to do so by tID members of the Board or by the Village Council, said special meetings to be upon reasonable notice to the members and the public if practical. One of the members shall be selected by the Board as its secretary, for the purpose of making a record of all proceedings of the meeting, which shall be transcribed and one copy filed with the Village Clerk. SECTION 4. The duties of the Board shall be to act in an advisory capacity to the Village Council. The Board shall study and plan a comprehensive plan for the Village, made i'dth the general purpose of guiding, providing and accomplishing co-ordinated, efficient and harmonious development of the Village which will, in accordance with presesent and future needs, best promote the health, safety, morals, order, convenience, prosperity, aesthetics and general welfare of the Village and the people thereof, as well as efficienCy and economy :L"l the process of the develop;lent of the Village, including among other things, adequate provision for light and air, and the promotion of the healthful and convenient distribution of population, the promotion of good of the Village and the adequate provision for public utilities and other improvements. $ SECTION 5. The recommendations of the Board to the Village Council shall be in writing and in duplicate, and shall show the estilnated cost and the suggested cr\ method or methods of financing. As soon a s convenient after the recommendations J are received by the Village Council, it shall consider and act on each recommendation f separately and approve, tentatively modify or disapprove the same and note its actions thereon on the margin of such recommendations, or on separate writing attached thereto. One copy thereof shall be retained by the Village Clerk, who shall forward the other copy thereof to the Chairman of the Board. - ~ . ., Ordinance #39 page two. \ SECTION 6. The Village Council may accept and adopt the recommendations of the Board, but it shall not reject or modify such recommendations without first giving to the Board an opport1ll1ity to be heard in support thereof. Such opportunity shall be exercised by the Village Planning and Zoning Board within thirty days following notice from the Village Council that they have withheld approval of any recommendations submitted to the Council by the Board. ., SECTION 7. "Whenever it is proposed by or to the Village Council that the zoning ordinance be altered, changed or amended, or any variance permitted thereunder, and the Village Council is of the opi..Tlion that such proposal merits the calling and holding of a public hearing on such proposal, a copy of the ordinance submitted to put such a proposal into effect, or a copy of the application for ~y variance, together with a copy of the notice of public hearj.ng thereon, shall be delivered by the Village Clerk to the Chairman of the Board from the Village Council not less than fifteen (15) days before such hearing. In the absence of the Chairman of the Board from the Village, such service shall be made on the Secretary of the Board in lieu of the Chairman. ~'fuen service of t he proposed ordinance or application and notice is made, as aforesaid, it shall be the d. uty of the Chairman or Secretary of the Board to :immediately call a meeting of the Board to consider the proposal. Upon consideration thereof, the Chairman thereof shall submit their recommendations thereon to the Village Clerk not less than forty eight hours before such hearing, and the Board or some designated person or committee thereof shall attend the public hearing, and shall be heard in reference to any statements there made against the recommendations of the Board. ~,...-.. r SECTION 8.
