AN ORDINANCE .ADOPl'ING A FIRE PRE.VEllTION CODE PRESCRIBING RmJLA.TIONS GOVBRIIING OONDITIONS IUZARDOUS TO LIFE AND PROPERlY FROM FlRE OR EXPLOSI:ON. BE IT ORDAINED BY THE VIILAGE OOUNCIL OF THE VIT.LAGE OF IDRTH ORLANDO, FIDRIDA: ~ SEnTION' 1. - Adoption of Fire Prevention Code There is hereby adopted by the Village of North Orlando for the purpose of prescribing regulations governing conditions hazardous to lite and property from fire or explosion, that certain code known as the FIRE PR.EI1E1iTION roDE, Abbreviated Edition, recoDmSlded by the National Board of Fire Underwriters, being particularly the 1960 edition thereof, and any future editions or revision~ and the whole thereof, save and except such portions as are hereinafter deleted, modified or amended (by Section; of this ordinance), of which code not less than three (3) copies have been and now are filed in the office of the Clerk of the Village of North Orlando and the same are hereby adopted and incorporated as .fully as it set out at length herein, and from the date on which tbis,ordirtance shall take effect, the provisions thereof shall be controlling within the limits of the Village of North Orlando, Florida. SECTION 2. EnforCentSlt The code hereby adopted shall be enforced by the Chief of the Fire Department. SECTION 3. Definition Wherever the word "Municipalityt' is used in the code hereby adopted, it shall be held to mean the Village of North Orlando. SECTION 4. Establishment of Limits of Districts in which storage of Flammable Liquids in Outside Aboveground Tanks, EUlk~Sl;orage of Liquefied Petroleum Gases and storage of Explosives and Blasti.n,g Agents is to be Restricted. The limits referred to in Section 73 of the Code hereby adopted in which storage of fiammable liquids in outside aboveground tanks is prohibited, the limits referred w in Section 103 of the code hereby adopted, in which bulk storage of liquefied petroleum gas is restricted, and the limits referred to in Section 53b of the code hereby adopted, in which storage of explosives and blasting agents is prohibited, are hereby established as follows: 3lch storage is prohibited without exception within the corporate limits of the Village of North Orlando. ",,r SEX;TION 5. Amendments made in the Code Hereby Adopted. 1. Wherever "Chief of the Fire Department" is used in the code hereby adopted, it shall be held to mean the Village Council or their duly designated representative. 2. Section 76 of the code hereb;y adopted, is amended by the addition of -2- l".... Paragraph f., to read as follows: No gasoline will be dispensed into a glass container of any kind at any time and metal containers for .such use shall be painted red, with the word .. gasolindl plainly shown thereon. 3. Section 326 of the code hereby adopted, is amended by the addition of paragraph h., to read as follows: Outside aboveground storage is authorized for not more than 110 gallons of fuel oil or kerosene used for cooking or heating and outside aboveground storage is authorized for not more than no cubic feet of bottled gas used. for cooJdDg or heating. SECTION 6. Modifications \:"!!1 The Chief of the Fire Department shall have power to modify any of the provisions of the code hereb;r adopted upon application in writing by the owner or lessee, or his duly authorized agent, when there are practical difficulties in the wtq of carrying out the strict letter of the code, provided that the spirit of the code shall be observed, public safety secured, and substantial justice done. The particulars of such moditications when granted or allowed and the decision of the Chief of the Fire Department thereon shall be entered upon the records of the department and a signed copy shall be furnished the applicant. SECTION 7. Appeals Whenever the Chief of the Fire Department shall disapprove an application or refuse to grant a permit applied for, or when it is claimed that the provisions of the code do not app~ or that the true intent and meaning of the code have been misconstrued or wrong~ interpreted, the applicant ~ appeal from the decision of the Chief of the Fire Department to the Village Council vdthin 30 dews from the date of the decision appealed. SEXm:ON S. Penalties A. Any person who shall violate al\Y of the provisions of the code hereby' adopted or fail to comply therewith, or who shall violate or fail to comp~ with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans subnitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or who shall fail to comp~ with such an order as affirmed or modified by the Village of North Orlando or by a court of competent jurisdiction, withilbwlae time fixed herein, shall eeveraJ.1y for each and every such violation and noncompliance respectively, be guilty of a misdemeanor punishable by a fine of not less than $ 1.00 or mre than $ ;00.00 ,or by imprisonment for not less than 1 '.- dtqs nor more than 60 dews or by both such fine and imprisonment. The imposition of one penalty for an.Y Dolation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or -... -3- ;- or remedy such violations or defects within a reasonable time; and when not otherwise specified, each ten dqs that prohibited conditions are maintained shall constitute a separate offense. b. The application of the above penalty shall not be held to Jrevent the enforced rem:>val of prohibited conditions smTION 9. Repeal. of conflicting Ordinances. All former ordinances or parts thereof conflicting or inconsistent with the :tr ovisions of this ordinance or of the code hereby adopted are hereby repealed. S1OOTION 10. Validity The Village of North Orlando hereby declares that should ar:ry section, paragraph, sentence, or word of this ordinance or of the code hereby adopted be declared for any reason to be invalid, it is the intent of the Village of North Orlando that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as mtq be declared invalid. smTION ll. Date of Effect ".... This Ordinance shall take effect immediately upon its passage and adoption by the Village Council of the Village of North Orlando, Florida.
