VILL.tl.GE OF NORTH ORLP.NDO, FLORIDA i~ ORDINANCE NO. 32 AN ORDINANCE RmULATING THE PRESENCE OF :MINORS UNDER THE AGE OF SWENTEEN YEARs IN PUBLIC 6TRmS AND OTHER PLACES BETWEm CEm'AIN HOURS: DEFINING IDTIES OF PARENTS OR OTHER IN CARE OF MINORS: PEOVIDmG FOR ARREb~ AND PENALTIES FOR VIOLATIONS THmmF: RFPEALING ORDINANCES IN CONFLICT THERn'ITTB. VlHEm!a.S, by reason of conditions now prevailing which have overtaxed the law enforcement agencies of the Village of North Orlando, Florida, because of influxes of population, the presence of numerous strangers and transients, and the like; and WHEREAS, due to these ccnditions now prevailing, juvenile criminal delinquency is likely to :result - in the Village of North Orlando as to become a menace to the preservation of public peace, safety, health, morals and welfare; NOW, Tl1.ffi]FORE, BE IT ENACTED BY THE COUNCIL OF THE VILLAGE OF NORTH ORLANDO, FroRIDA: SECTION 1. Loitering of Minors Prohibited. It shall be unlawful for any minor under the age of seventeen (17) years to loiter, idle, wander, stroll, or ,.,..l, p1~ in or upon the public streets, highw~s, roads, alleys, parks, pls\ygrounds, \ ' wharves, dOCks, or other public grounds, public places and public buildings, places i of anDJ.sement and entertainment, vacant lots or other unsupervised places, including the }resence of aIq such minor on bicycles, motor scooters, or in automobiles or other vehicles between the hours of '9:.30 P.M. and 6:00 A. M. of the following d8\Y, official city time. Provided, however, that the provisions of this Section do not app~ to a minor accompanied by his or her parent, guardian, or other adult person having the care f4I1d custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian, or other adult person having the care and custody of the minor. Each violation of the provisions of this Section shall constitute a separate offense. '- SECTION 2. RespOnsibility of Parents. It shall be unlawful for the parent, guardian, or other adult person having the care and custody of a minor under the age of seventeen (17) years to knowing~ permit such minor to loiter, idle, wander or plq in or upon the public streets, highw8\Ys, roads, alleys, parks, pl~grounds, wharves, docks, or other public grounds, public places and public buildings, places of amusEment and entertainment, vacant lots or other unsupervised places, including the presence of a.tW' such minor on bicycles, motor scooters, or in auto- mobiles or other vehicles between the hours of "9i.30 P.JI. and 6:00 A. M. of the following dq, official city time. Providing, however, that the provisions of this Section do not app~ when the minor is accompanied by his or her parent, guard- ian or any other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian, or other adult person having the care and cu::t.ody of the minor. Each violation of the provisions of this Section shall constitute offense. - -- , .01. '- . ;.::. I i -2- SIDrION 3. Penalties. Any minor violating the provisions of Section 1 shall be dealt with in accordance with Juvenile Court law and procedure. Any parent, guardian, or other adult person having the care and custody of a minor violating Section 2 shall be fined not more than One Hundred ($100.00) dollars or confined in jail not more than thirty (30) d8\Ys. or punished by both said fine and imprisonment for each offense. S~TION 4. Repeal of Conflicting Ordinances. All existing Ordinances of the Village of North Orlando are herebT repealed insofar as they ma.v be inconsistent with the provisions of this Ordinance. SECTION 5. Separability of Provisions. It is the intention of the Village C~il that each separate provision of this Ordinance shall be deemed indepen- dent of all other provisions herein, and it is further the intention of the Village Council that if aqy provisions of this crdinance be declared invalid, all other provisions thereof shall remain valid and enforceable. S~TION 6. This Ordinance shall take effect iDmediately upon its passage and adoption by the V::.llage Council of the Village of North Orlando, Florida.
