ORDIANCE NO. 24
AN ORDINANCE TO REGUIATE THE SALE OR FURNISHING
OF PACKAGE BEER-WINE-ALE IN THE VILLAGE OF NORTH
ORIANDO, FLORIDA: REQUIRING A PERMIT TO BE OB-
TAINED FROM THE VILLAGE COUNCIL AND THE PAYMENT
OF AN ANNUAL LICENSE TAX TO ENGAGE IN THE BUSINESS
OF SELLING BEER-WINE-ALE; PRESCRIBING THE AMOUNT
CF SUCH LICENSE TAX AND THE LICENSE YEAR THEREFOR:
PROVIDING A PENALTY FOR THE VIOIATION OF THE PRO-
VISIONS OF THIS ORDINANCE, AND REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH.
SECTION 1: License Required. That no person shall engage in
the business of selling beer-wine and ale in the Village of North Orlando,
Florida, without first obtaining from the Town Council of said town a license
so to do and without paying the license tax hereinafter provided. Licenses
shall be issued only to persons of good moral character who have not been
convicted of any offense involving moral turpitude, who are at least 21
years of age and only to such corporations whose officers and directors
are persons of good moral character. Application for such license shall
be filed with the Town Tax Collector in duplicate in writing under oath on
such form as shall be approved by the Town Council. The application shall
designate the exact place or places where it is proposed to conduct such
business and the name or names of the person or persons to be in charge
thereof. The Town Tax Collector shall file the said application with the
Town Clerk who shall present said application to the Village Council at
its next regular meeting or any special meeting called far the purpose of
considering said application, and the Village Council may grant or may
defer the same for investigation or may refuse to grant said license if
in their opinion the best interests of the village so require. If the
application for licenses is approved by the Village Council, the Village
Tax Collector shall thereupon issue a license to said person upon the
payment of the license tax hereinafter provided. The license shall be in
triplicate, the original to the applicant, a copy sent to the state
Beverage Department and a copy to be retained by the Village Tax Collector.
If a majority of the Village Council refuse to grant said license, the
Village Clerk shall endorse the action of the Village Council upon the
application and return the same to the Village Tax Collector who shall
file the original and send the copy with the endorsement of the action of
the Village Council thereon to the state Beverage Department. No license
shall be granted to a vendor, except a vendor of wines, beer and ale only.

SECTION 2: Amount of License Tax and License Year.
that the following shall be the amounts of any license taxes to be paid:
(a) For vendors who may sell only Beer, Wine, and Ale
Fifteen Dollars ($15.00)
(b) The license year for which such license tax shall be
paid shall begin on the first day of October and end on the 30th day of
September of the following year, except that any person applying for
license before the first day of October shall be entitled thereto upon
the payment of one-half of said annual license tax and thereafter such
license tax shall be payable on the first day of October ot each Year.
Vendors may at any time obtain a license for a period of six months from
the date of license upon the payment of two-thirds of the annual license
tax herein required.
SECTION 3. No license shall ever after be issued in the name (Invalid as per
of any other person for the person whose license has been revolked or sus- State Statue)
pended. No part of the license tax paid shall be refunded upon the revo-
cation or suspension of the license.
SECTION 4. Prohibiting the Sale to Minors or Intoxicated
Persons. No person who is a vendor of Beer-Wine-Ale by himself, itself
or another, shall sell or cause to be sold or furnished or permit any person
in his employ to sell or furnish any minor or any person who is intoxicated
or drunk any intoxicating liquor in any quantity.
SECTION 5. That it shall be lawful to sell beer-wine-and
ale trom 7:00 .AM until 12:00 PM every day Monday through and including Sunday
SECTION 6. That it shall be unlawful to sell beer-wine or ale
from 7:00 AM to 7:00 PM on special or primary election days, either national,
state, county, or municipal.
SECTION 7: Meaning of Terms. That in this ordinance the word
vendor shall include all persons, associations of persons or corporations
selling beer-wine-ale at retail and all persons comprising a firm, as well
as the persons actually violating the provisions hereof, shall be liable
for prosecution hereunder for the violation hereof of any officer of the
corporation, employee of the firm or agent of the corporation.
SECTION 8: Penalties. That any vendor found guilty of viola-
tion of any of the provisions of this ordinance shall be punished by a fine
not exceeding Two Hundred ($200.00) Dollars and/or the revocation of license,
or by' imprisonment not exceeding ninety (90) days, and each sale of Beer-Wine-;
Ale in violation hereof shall constitute a separate offense punishable here-
under.
SECTION 9: Repeal of Confiicting Ordinances. That all ordinances,
or parts of Ordinances in conflict herewith be and the same are hereby repealed.
SECTION 10. Effective Date. This Ordinance shall become ef-
tective immediately upon its passage by the Village Council of the Village of
North Orlando, Florida, and approval by the Mayor of said Village.
SECTION 11: This ordinance shall become effective on the 15th
day of September 1962 upon its passage by the Town Council and approved by
the Mayor.
