AN ORDINANCE TO LICENSE AND TO REGUIATE THE KEEPING
OF DOGS WITHIN THE VILIAGE OF NORTH ORLANDO, FWRIDAJ
ESTABLISHING THE METHOD BY WHICH SAID LICENSES SHALL
BE OBTAINED; FIXING THE FEES TO BE PAID THEREFOR;
PRESCRIBING CERTAIN RULES AND REGUIATIONS PERTAINING
TO THE KEEPING OF DOGS; PROVIDING FOR THE IMPOUNDMENT
OF DOGS IN THE DOG POUND OF THE HUMANE SOCIETY OF
S>>1INOLE COUNTY, FLORIDA; AND PROVIDING PENALTIES FOR
THE VIOLATION OF THE PROVISIONS OF THIS ORDINANCE.
BE IT ORDAINED by the Village Council of the Village of North Orlando:
Section1: That this ordinance shall be known as the "Dog Ordinance" of
The Village of North Orlando, Florida, and hereafter may be referred
to by that title.
Section 2: That the use of the term "Ownerll, as hereinafter contained,
is hereby defined to include any person or persons, firms, associa-

tions or corporations owning, harboring, or keeping a dog or dogs
within the territorial limits of the Village of North Orlando.
Section 3: That the term "Chief of Police", as used in this ordinance,
shall mean the Chief of Police of the Village of North Orlando and
such police officers of the Village of North Orlando as the Chief
of Police may designate to assist him in carrying out and enforcing
the provisions of this ordinance.
Section 4: That the term "Dog Pound" as used herein, means the Dog
Pound of the Humane Society of Seminole County, Florida.
Section 5: That hereafter it shall be unlawful for any person, persons,
fi~, or corporations to own, possess, keep, or harbor a dog within
the Village of North Orlando without first having the said dog inoou-
lated annually for rabies and thereafter obtaining a license far suCh
dog in compliance with the provisions hereinafter set forth, save
and except that an inoculation against rabies and a license shall
not be required for dogs under the age of six months.

Section 6:
That the Owner of every dog shall procure an annual license

for such dog on or before the first day of August of each year, ex-
cept as hereabove set forth; said license to be issued by the Chief
of Police of the Village of North Orlando and shall expire on the
31st day of July of the next succeeding year.
Section 1: That the Chief of Police of the Village of North Orlando
shall issue a dog license to each Owner upon the application there-
for, first having complied with the following regulatioll3:
(a) Each Owner shall file an application with the Chief of Police
of the Village of North Orlando on a form to be furnished, stat-
ing therein the full name and residence address of the said owner,
together with a description of the dog to be licensed. Said appli-
cation shall be accompanied by a certificate of a veterinary doctor

certifying that thirty days prior to date of application the dog
has been inoculated against rabies and the date and place of such
inoculation.
(b) Each applicant shall pay to the Village of North Orlando an
annual license fee of $2.00 for each dog.
( c) Should a change oecur in the ownership of a lieensed dog,
the 1ieense so issued may be transferred to the new CMner and the
1ieense so transferred shall be valid for the unexpired term of
the license year for which it was issued.
Section 8: That the Chief of Police shall furnish each applicant or
owner, simultaneously with the issuance of the license, and with-
out additional charge, a metal tag which shall have plainly printed
or stamped thereon the following: "The Village of North Orlando",
the expiration date and consecutively numbered. A record of each
number and the date the license was obtained shall be maintained
by the Chief of Police to be used for identifying lost, strayed

or impounded dogs.
Section 9: That no dog licensed, muzzled, unmuzzled or inoculated
against rabies shall be allowed upon the public thoroughfares, s
streets avenues or alleys of the Village of North Orlando, or in
public places such as restaurants, theaters, public conveyances

and the like, or upon property other than that of its owner, un-
less the dog shall be fastened to a suitable leash of dependable
strength, not to exceed 8 feet in length, or unless the animal is
under the control of the Owner or other responsible person known
to the dog; said Owner or other responsible person shall be within
a distance of three hundred (300)feet from the animal at all times,
unless the dog is running on property other than that of its Owner
with the express or implied consent of the ();mer of the property.
Any female dog in heat must be on leash at all times when in public
places or on the public streets or on premises other than that of
the owner.
Section 10: That no dog, whether on leash or. without leash, muzzle6,
or unmuzzled, shall be permitted at any time to enter a store in
the Village of North Orlando where food for human consumption is
held for sale, and it shall be t re duty of the OWner or manager of
such store to post a sign in a conspicuous place and manner appris-
ing dog owners that dogs are not permitted within the premises.
Section 11: That each dog over the age of six months shall wear a sub-
stantial, durable collar or harness at all times, to which a
license tag shall be securely attached; said tag shall not be teed
on the collar or harness of any dog other than the one for which it
was issued, and no person shall remove the collar or tag, or both,
from any dog without tre consent of the Owner to whim the license
was issued.

Section 12: That it shall be the duty of the Chief of Policy to en-
force the licensing provisions of this Ordinance. Whenever said
Chief of Police shall have knowledge of an unlicensed dog and the
Owner thereof beihg known, he may give written notice to the Owner
of such unlicensed dog or dogs informing the Owner that unless a
license shall be secured from the Chief of Police of the Village
of North Orlando within five (5) days from the date of said notice
and payment made of the regular license fee prerequisite to the
issuance thereof, the unlicensed dog shall be seized; any unlic-
ensed dog so seized shall be impounded in the dog pound.
Section 13: That any unlicensed dog the Owner of which i3 unknown to
the Chief of Police, or any dog running at large, wi thin the pro-
visions of Section 8 of this Ordinance, shall be seized by any
police officer of the Village of North Orlando and shall be im-
pounded in the Dog Pound. If it is impractical to captur~ such
dog for the purpose of impounding, it shall be the duty of the
police officer to kill such dog. That upon any dog licensed or
unlicensed being impounded in the Dog Pound under this Ordinance,
the Chief of Police shall promptly notify the Owner of such dog
of such impounding. If the name and address of the OWner is known
to the Chief of Police, notice shall be given to the Owner by mail,
and if unknown, notice shall be given by posting same in three
conspicuous places in the Village of North Orlando, to-wit: at the
Village Hall, at the school bus shelter, and at the North Orlando
Homes Sales Office. Notice to the OWner, as hereinabove provided
for, shall contain a description of the dog, the date impounded,
and the advice that the dog will be sold or otherwise disposed of

unless reclaimed and repossessed by the Owner within ten (10) days
from the date of impounding.
Section 14: That it shall be the duty of every Owner of a dog, licensed
or unlicensed, which is lost, strayed, or stolen, to promptly to
notify the Chief of Police in writing, and said notice shall contain
a description of the dog, the date when lost, strayed, or stolen,
and the Owner's name and residence address.
Section 15: That the Owner of any impounded dog may reclaim and repossess
said dog at any time within ten (10) days after the impounding and
upon payment of a fee of $2.50 per day for the care and maintenance of
the dog while impounded, and in the case of an unlicensed dog, upon
obtaining a license for such dog as herein provided for.
Section 16: That if the Owner of any dog, licensed or unlicensed, fails
to reclaim and repossess such dog within ten (10) days from the date
of impounding, the Chief of Police may cause said dog to be sold or
otherwise disposed of, and in the event of sale, the proceeds of the
sale shall first be applied to defray the cost of care and maintenance
of the dog while impounded, and the balance then remaining shall be
paid to the Owner of the dog if known, and if the said Owner is un-
known, the said balance shall be paid into the treasury of the Vil-
lage of North Orlando and credited to the General Fund, the same as
all other fees and charges collected under this ordinance - and
which fees, charges, and proceeds of sales are hereby appropriated
to defray the cost of license tags, clerical costs, and the care of
impounded dogs which are not claimed and repossessed by the Owner.
Section 17: That any dog inflicted with rabies, or which displays
symptoms of rabies, or any dog that has bitten a person or persons
within a period of fifteen (15) days prior to knowledge of such

biting being brought to the attention of the Chief of Police, shall
be seized and impounded in the dog pound and maintained therein for
a period not exceeding fifteen (15) days; if, upon expiration of such
fifteen (15) days period the dog shall be living and not afflicted
with rabies during this tim3, it shall be returned to the Owner there-
of on the sixteenth (16) day follaving quarantine. As an alternative
quarantine, the Owner of the dog may desi~nate a veterinary hospital
to care for and maintain the dog during the fifteen-day quarantine
period. All charges for care and maintenance of such dog while in
quarantine shall be paid by the Owner of the dog. If it is impractical
to capture such dog for the purpose of impounding, it shall be the duty
of any police officer to kill such dog.
Section 18: That the seizure or keeping of a dog by any person exdept the
true Owner thereof, shall be unlawful, and the unauthorized possession
of a dog by such person or persons without first having reported such
possession to the Chief of Police within a period of twenty-four (24)
hours after the dog has come into the possession of the person holding
the animal, shall be presumptive evidence of an intent to steal the
dog.
Section 19: That any person or persons who shall keep or harbor or own
any dog in the Village of North Orlando which is destructive or in-
dulges or engages in frequent or habitual barking, yelping or howling,
or which is mean or vicious, thereby creating annoyance to the inhabi-
tants of the neighborhood in which the dog is kept or to people passing
on the public streets, or any person who shall refuse to deliver his
dog or dogs to the Chief of Police when requested to do so under the
provisions of this Ordinance, or any person keeping, harboring, or
owning a dog who is cruel and inhumane to the animal, such cruelty
and inhumaneness consisting of unnecessarily beating, torturing,

mutilating, or cruelly killing the animal of failing or neglecting
to provide suitable food, or drink in sufficient quantities, together
with adequate shelter for such animal, and any person who steals any
dog or who abandons an aged, sick, disabled or otherwise unwanted dog,
shall be deemed guilty of a misdemeanor and subject to the penalties
provided for in this ordinance.
Section 20: That~ person or persons, firms, associations or corpora-
tions violating any of the provisions of this ordinance, upon convic-
tion thereof, shall be punished by a fine not to exceed Two Hundred
Dollars (200.00), or bv imprisonment for a term not to exceed sixty
( 60) days, or by both such fine or impris onment, in the dis cretion
of the Municipal Judge. Upon the conviction of any person owning or
harboring a mean or vicious dog, the Municipal Judge may order the
Chief of Police to cause such dog to be destroyed.
Section 21: The Mayor may order, whenever in his judgment the public
safety requires such action, that for a reasonable given time all
dogs. shall be securely muzzled when outside the private premises of
their Owners or keepers. Any dog found at large duri~ the prescribed
period provided for hereby , without being securely muzzled may be
killed by any policemen.
Section 22: Any person who in any way interferes with the police or hinders
any officer in the performance of any required duty under this Ordinance
shall, upon conviction thereof, be punished as provided in Section 20
of this Ordinance.

Section 23: That should any section, subsection, clause or provision of

this Ordinance be declared by a court of competent jurisdiction to
be invalid, such declaration shall not affect the validity of this
Ordinance as a whole, or any part thereof other than the part so
declared to be invalid.
PASSED AND ADOPTED by the Village Council of the Village of North Orlando,
Florida, this 3rd day of May 1960.
