THIS WARRANTY DEED, executed this day of~(~ V" , 1999, by and between
Ava Anthony, Inc., the Party of the First Part and City of inter Springs, Florida, the party
of the Second Part.
WITNESSETH
WHEREAS, ths hereinafter described property held by Ava Anthony, Inc., a Florida
Corporation is needed for public improvements, Ava Anthony, Inc, on„(,]T; ~- ~, i ~~~y has
approved conveyance to the Grantee without consideration, to be used solely for Public
Purposes, pursuant to the provisions of Section 337.25 (4), of the Florida Statutes.
WHEREAS, the City of Winter Springs needs the right of way to improve and
realign the entrance to S.R. 434, and
WHEREAS the City of Wint®r Springs will utilize said right of way for ingress and
egress from Hayes Road to S.R. 434.
NOW, THEREFORE, THIS INDENTURE WITNESSETH: That the Party of the
First Part does hereby remise and release unto the party (parties) of the
Second Part, and forever, all right, title and interest of Ava Anthony, Inc. to the
property described on Exhibit "A", Aca~tion Parce{, attached hereto and made a
part thereof, with the terms and conditions set forth therein.

THIS CONVEYANCE is further conditioned on the following:
All rights of access from adjoining property owned by the party of the First Part and aH rights
pf light, air and view are hereby reserved to the Party of the First Part. In addition, if,
at any time Party of the Second Part abandons the property, ceases use of the property for
Public Purposes, all right, title and interest in and to the property shall automatically
revert to the Party of the First Part.
The Grantor hereby covenants to said Grantee that at the time of delivery of this deed m
the property was free from all encumbrances made by him, except taxes accruing
subsequent to December 31, 1998, and that he will warrant and defend the same o
against the lawful claims and demands of all persons claiming by, through, or under him
but against none other. No other warranties, express or implied, are given by this ~~,
Public Purpose Warranty Deed.
