Alcala 509 Shadow Glen Place Winter Springs, FL 32708 RE: Offer of Employment Dear Mr. Alcala: This letter confirms our offer of the position of Information Technology Coordinator/Security Administrator with the City of Winter Springs. This letter will outline the terms and conditions of your employment, but should not be construed as a contract of employment. Your duties will include, without limitation, the duties outlined in the attached job description. The duties outlined qualify you as exempt from the overtime provisions of the Fair Labor Standards Act. Please understand that your employment is subject to the discretion of the City and is considered employment at will. In other words, you are free to terminate your employment with the City at any time and the City retains the same right. Your beginning gross annual salary will be $53,000. At some time during your employment, you may become eligible for a merit increase, a cost of living increase, an increase related to a salary range adjustment, or some other adjustment in your salary. Your salary will be paid in equal bi-weekly installments. Your salary will be paid subject to all required deductions, including federal withholding, FICA, and, after 6 months, a mandatory pension contribution (currently 3%) etc. You will receive all benefits normally offered by the City including, without limitation, health insurance, life insurance, long term disability insurance, vision insurance, dental insurance, and/or pension benefits. Additionally, you will be eligible to accrue vacation leave, sick leave, paid holidays, and bereavement leave. Other terms and conditions of employment are set forth in the City's Personnel Manual, a copy of which will be furnished to you on your first day of employment. A copy of the Personnel Manual is also available at www.wintersprinqsfl.orq. Please review the Personnel Manual carefully, as it sets forth the City's policies and procedures relative to employment issues that may directly affect you. Please understand that neither the Personnel Manual nor any part of it is a contract of employment. Further, please understand that the Personnel Manual cannot anticipate every circumstance or question about policy or procedure. The City reserves the right to revise, supplement, or rescind any policy or portion of the Personnel Manual in its sole and absolute discretion. This offer is contingent upon you passing the required drug screening and background check. Please be aware that this background check is performed by our police department and is equivalent to that done on a police officer. This background check also includes contacting current and previous employers. You also agree to: · Complete your CISSP certification by September 30,2005. · Complete your Security + certification by November 30,2005. · Begin CCNA classes in the spring of 2006 and aggressively pursue the CCNA certification in the least amount of time as possible. The City expects that you will perform your duties conscientiously and with a sense of dedication and pride in your work. In return, you can expect to be treated professionally and fairly. Please respond to this letter within five (5) days or it will be automatically withdrawn. TECHNICAL TRAINING PROGRAM ADVANCED COSTS AGREEMENT - THIS AGREEMENT, entered into on the h day of . kl ft Q. , 20 csJ, by and between the CITY OF WINTER SPRINGS, a Florida municipal corporation ("City") and Jb..~", LJ. A l f rL\ 0... , an employee of the City's Information Services Department ("Employee") hereby execute this Technical Training Program Advance Costs Agreement. WITNESSETH: WHEREAS, the City benefits from the advanced training of its employees; and WHEREAS, the City understands the costs associated with tuition and books may prohibit interested qualified employees from participating in technical training programs; and WHEREAS, the City believes advancing these costs will provide for a greater participation of qualified information service personnel; and WHEREAS, this Agreement is in the best interest of the health, safety and welfare of the Citizens of the City of Winter Springs. NOW THEREFORE, in consideration of the mutual covenants contained herein the parties agree as follows: 1. The foregoing recitals are incorporated herein fully by this reference. 2. The C~ty agrees to advance the costs associated with tuition and books to the Employee for technical training programs approved by the City Manager. 3. If Employee received a grant, scholarship or other fmancial assistance for tuition or books, the Employee will only be entitled to advance equal to the sum necessary to pay for tuition and books after application of the grant, scholarship or other financial assistance. 4. The Employee understands and agrees that class attendance is the responsibility of the Employee and shall be after normal business hours and uncompensated, however, the Employee may attend during normal business hours at the sole discretion of the Information Services Director. 5. If the Employee fails to successfully and satisfactorily complete the technical training, the entire amount of the funds advanced by the City shall be reimbursed to the City by the Employee within thirty (30) days or as otherwise agreed to by the parties in writing. 6. If the Employee leaves the employ of the City for any reason within a two (2) year period of completing the technical training program, the Employee shall reimburse the City a pro-rata sum, based upon the percentage of time remaining in the two (2) year period. (For Example: If the Employee leaves the employ of the City one and one-half (1 Yz) years after completion, the employee would have been employed for seventy-five percent (75%) of the required time, therefore twenty-five percent (25%) of the costs advance would be due). Nothing in this Agreement shall be interpreted or be construed to modify the at-will nature of the Employee's relationship with the City. -1- 7. The Employee agrees that any wages due from the City to the Employee at the time the Employee leaves the employ of the City will be held by the City, to the extent permitted by law, to reimburse the pro-rata share due under section 6 above. In the case where wages due the Employee are not sufficient to wholly reimburse the City, the Employee promises and covenants to repay the remaining sum, after application of the wages due, within thirty (30) calendar days ofleaving the employ of the City or as otherwise may be agreed by the parties in writing. Any wages due by the City in excess of the sums to be reimbursed will be released immediately to the Employee. 8. The Employee agrees that any and all costs associated with collecting any sums due for reimbursement, including any fees charged by a collection agency shall be borne and paid by the Employee. Additionally, should the City choose to bring a civil action to collect the sums due and is successful in such action, the employee shall be responsible for any reasonable attorney's fees and costs incurred by the City.
