HomeMy WebLinkAboutFirst Baptist Church of Winter Springs Maintenance Bond -2002 01 28 MAINTENANCE BOND (with surety) Bond No. 1044400 KNOW ALL MEN BY THESE PRESENTS: That FIRST BAPTIST CHURCH OF WINTER SPRINGS. INC, hereinafter refen'ed tows "Principal, and XL SPECIALTY INSURANCE COMPANY , a surety company authorized to do business in the State of Florida, hereinafter referred to as "Surety", are held and firmly bound unto the City of * hereinafter referred to as the "City", in the full and just sum of ~ i o , 000.00 lawful money of the United States of America, to be paid to the City of * to which .payment well and truly to be made, we bind ourselves, our heirs, executors, administrators, successors, and assigns, jointly and severally,. firmly by these presents. * CITY OF WINTER SPRINGS, FLORIDA WHEREAS, the above bound Principal, as a condition precedent to the approval by the City of a certain development known as FIRST RAPTTST CHTTRCH OF WTNTF.R GPRTN(_S , has covenanted and agreed with the City to construct DRiDTKiNG WATER SYS . .and other improvements based upon development plans and specifications pertaining to said development, said development plans and specifications by being dated ~ _ and being on file with the City Engineer, and - WHEREAS, it is a condition to the approval of said development that this bond be executed; WHEREAS, Principal is obligated to protect the City against any defects resulting from faulty materials or workmanship of said improvements and to maintain said improvements for a period of two (2) years from JANUARY 28, 2002 or until released in writing by the City; NOW, THEREFORE, the conditions of this obligation are such that if the bonded Principal shall promptly and faithfully protect the City against any defects resulting from faulty materials or workmanship of the aforesaid improvements and maintain said improvements for a period of two (2) years from JANUARY 28 , 2002 ~ then this obligation shall be null and void, otherwise it shall remain in full force and effect until released in writing by the City. The City shall notify the Principal in writing of any defect for which the Principal is responsible and shall specify in said notice a reasonable period of time within which Principal shall have to correct the defect(s). The Surety unconditionally covenants and agrees that if the Principal fails to pertorm, within the time specked, the Surety or its authorized agent or ofFcer, upon not cation of the default by the City, will forthwith con-act such defect or defects and pay the cost thereof, including, but not limited to engineering, legal and contingent cost. Should the Surety fail or refuse to correct said defects, the City, in view of the public interest, health, safety, welfare and factors involved, and the consideration in approving and filing the said development shall have the right to resort to any and all legal remedies against the Principal and Surety and either, both at law in equity, including specifically, specific pertormance to which the Principal and Surety unconditionally agree. The Principal and Surety further jointly and severally agree that the City at its option, shall have the right to correct said defects resulting from faulty materials or workmanship, or, pursuant to public advertisement and receipt of bids, cause to be corrected any defects or said defects in case the Principal shall fail or refuse to do so, and in the event the City should exercise and give effect to such right, the Principal and the Surety shall be jointly and severally [liable] hereunder to reimburse the City the total cost thereof, including, but not limited to, engineering, legal, and MAINTENANCE BOND (with surety} Bond No. 1044400 contingent cost, together with any damages, either direct or consequent, which may be sustained on account of the failure of the Principal to correct said defects..
