BILL OF SALE
KNOW ALL MEN BY THESE PRESENTS: That Hubert R Earley,
(hereinafter referred to as the DEVELOPER), for and in consideration of the sum ofTen
and no/l 00 ($10,00) Dollars and other good and valuable considerations to it paid by the
CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA (hereinafter
referred to as the CITY), has granted, bargained, sold, transferred, set over and delivered,
and by these presents does grant, bargain, sell, transfer, set over and deliver unto the
CITY, its successors and assigns, all those certain goods and chattels described as
follows:
Water, reclaimed water, sewer and stm:m.water systems constructed within the
common areas as shown and described on the he plat of Creeks Bend
TO HAVE AND TO HOLD the same unto the CITY, its successors and assigns
forever.
And the DEVELOPER for itself and its successors, hereby covenants to and with
the CITY, its successors and assigns, that it is lawful owner of the said goods and chattels
that they are free from all liens and encumbrances, that it has good right to sell the same as
aforesaid, and that it will warrant and defend the same against the lawful claims and
demands of all persons whomsoever.
In addition, the DEVELOPER hereby warrants said water, reclaimed water,
sewer and stgJ'.IW.Jl~~r service systems to be free from defects due to installation and/or
materials for a period oftwenty-four(24) months from the date of execution of this
document and DEVELOPER further agrees to reimburse the CITY in full for reasonable
and necessary repairs (as determined by the CITY); due to said defects during the-twenty-
four(24) month period: cost of same shall be set out on an invoice form the person
performing the repairs,
IN WITNESS WHEREOF, the DEVELOPER has caused its name to be hereunto
