CALL TO ORDER
Chair Stephen Gildea called to Order the Tuesday, August 26, 2025, Regular
Code Enforcement Board at 5:30 p.m., in the Commission Chambers (City Hall,
Road 434, Winter Springs, Florida 32708.)

A moment of silence was held followed by the Pledge of Allegiance.

Deputy Chief Presley noted that items 503 and 504 were being removed from the agenda as
they had come into compliance.
City Clerk Christian Gowan swore in those who would be providing testimony.

Inspector Elbon introduced the case, offered testimony on the procedures of notice and the
violation, and showed photos from the "Presentation." The Board accepted the packet as
published into evidence without objection. Officer Elbon recommended a compliance date of
September 25, 2025 and a fine of up to $250 per day violation if this was not met.
Discussion followed on communications with property owner, occupancy of the property,
communication with permitting staff, and the difference between accessory structures and
accessory dwelling units.
"I MOVE TO FIND THE PHOTOGRAPHS AND TESTIMONY OF CODE OFFICER CHRISTOPHER
ELBON CLEARLY SHOW THAT THERE IS SUFFICIENT SUPPORT TO SUBSTANTIATE THE
ISSUES PRESENT WITH THE PROPERTY AS IT RELATES TO A VIOLATION OF FLORIDA
BUILDING CODE, FBC CODE SECTION 105.1, PERMITS REQUIRED AND ORDER THAT THE
RESPONDENT BE GIVEN UNTIL SEPTEMBER 25, 2025 TO ESTABLISH COMPLIANCE. IN THE
EVENT THE VIOLATION IS NOT CORRECTED, A FINE OF ONE HUNDRED AND FIFTY
DOLLARS ($150) SHALL BE IMPOSED PER DAY UNTIL COMPLIANCE IS REPORTED TO AND
VERIFIED BY THE CITY CODE ENFORCEMENT." MOTION BY BOARD MEMBER GALLO.

Discussion followed on zoning requirements and what was allowed in different zoning
classifications and safety concerns associated with unpermitted conversions to single-family
residences.
"I MOVE TO FIND THAT, BASED ON THE INSPECTOR'S TESTIMONY, THE PHOTOGRAPHS
AND ALL OF THE EVIDENCE THAT WAS PRESENTED, SHOWS THAT THERE ARE, IN FACT,
VIOLATIONS OF WINTER SPRINGS CODE SECTION 20-182, USES PERMITTED IN THAT THIS
PROPERTY IS BEING USED FOR THREE AIRBNB RENTALS IN A SINGLE FAMILY ZONE, AND
THAT THE RESPONDENT IS IN VIOLATION OF THE CITY CODE. I MOVE THAT THE
RESPONDENT BE GIVEN UNTIL SEPTEMBER 5, 2025 TO CORRECT THE VIOLATIONS. IN THE
EVENT THAT RESPONDENT FAILS TO COMPLY BY THIS DAY, A FINE IN THE AMOUNT OF
TWO HUNDRED AND FIFTY DOLLARS ($250) SHALL BE IMPOSED PER DAY UNTIL
COMPLIANCE IS REPORTED TO AND VERIFIED BY CITY CODE ENFORCEMENT." MOTION

September 25, 2025 and a fine of up to $250 per day violation if this was not met.
Discussion followed on what was required to convert the structure in question back to an
approved accessory structure rather than an accessory dwelling unit.
"I MOVE TO FIND THAT THE PHOTOGRAPHS AND TESTIMONY OF OUR INSPECTOR SHOW
THAT THERE ARE ACTUAL FINDINGS OF A VIOLATION OF WINTER SPRINGS, CODE OF
ORDINANCE, SECTION 6-84(A) AND THAT THE RESPONDENT BE GIVEN UNTIL SEPTEMBER
25, 2025 TO BRING THE PROPERTY INTO COMPLIANCE WITH SAID SECTION. IF NOT
BROUGHT INTO COMPLIANCE, A DAILY FINE OF TWO HUNDRED DOLLARS ($200) A DAY
SHALL BE ASSESSED UNTIL BROUGHT INTO COMPLIANCE." MOTION BY VICE -CHAIR
MARTIN. SECONDED BY BOARD MEMBER KAPROW. DISCUSSION.
