HomeMy WebLinkAboutRed Fox Trucking Agreement -1984 01 26 y \ A G R E E MEN T THIS AGREEMENT made this cl? r.( day of 9an..U.4A7' by and between the City of Winter Springs (hereinafter referred to as "City"), , 1984, and Red Fox Trucking, Inc. (hereinafter referred to as "Contractor"). WHEREAS, City desires to engage an independent contractor to load clay, approximately 3,500 cubic yards from a stockpile located on the south side of Trade Winds Road, near Hayes Road, adjacent to Wander Lake, haul and deposit at various locations designated by the City. WHEREAS, the Contractor desires to render the loading, hauling and depository service referred to above for the City. NOW, THEREFORE, in consideration of the terms and mutual covenants hereinafter set forth, the parties agree as follows: 1. The Contractor shall furnish one front end loader with a five (5) cu. yd. bucket and operator at an hourly rate of $75.00 per hour; four (4) dump trucks with a minimum capacity of eighteen (18) cu. yd., with drivers at an hourly rate of $35.00 per hour each to perform the services referred to above. Contract maximum amount not to exceed $10,320.00. 2. City and Contractor agree that this work effort shall be completed within six (6) working days, weather permitting. Any material not removed from the stockpile and deposited as required within six (6) working, workable days shall be loaded, hauled and deposited at no cost to the City. 3. Payment for work performed under this Agreement shall be made to the Contractor within one (1) week following the satisfactory completion of the services identified in paragraph 2 above. 4. City and the Contractor agree that it is the intention of the parties that the contractor be an independent contractor and not an employee of " \ , the City under this Agreement. In order to protect the City from liability, the Contractor shall provide standard general liability insurance, all insurance as may be required by local, state and federal laws and regula- tions and shall further indemnify and hold City harmless from any and all claims arising out of the performance of his duties under this Agreement. The Contractor shall be responsible for compensation and benefits for its operators and employees. 5. The Contractor shall begin the work effort under this Agreement within seven (7) calendar days after execution of this Agreement.
