\~HERE:AS, -134 has submitted to tlie CITY a Px.-elim1nar:y
Subdivision Plan (herein referred to as the "Preliminary Plan"
and attached hereto as ExhIbit "A") beating date July 1, 1988 and
amended through November 10, 1908, prepared by Donald W. McIntosh
Associates, Inc., containing pages 1 through 5 inclusive, ,for
review and ~rellmlnnry Plan approval (sard approval was granted
by the CITY on December 12, '1906) with l:9spect to certaIn real
property desc~ibed in B~hibit "B~ attached hereto and made a part
hereof, herein referred to as the "property"! ~nd
WH8REAB, It ia the intent of 4)~ to develop on add Proper"ty.

WHEREASt the parties desire to ~educe to writing their
several agreements relating to the anticipated construction of
400 s!ngle family lots On the Property.
NOW TUEREFORE, in consider Hion of the premises, th~ commi t-
menta, and the undertakings set out hg(~inaf~er, and other good
and valuable considerntion, th~ receipt and sufHcieney of which

The City Commission of the CITY, approves the proposed
development On the pcopecty, subject specifieally to the
fOllowing c6nditlons reqUired by the City Com~lsslon of the CITY,
1n fo(m~l public meetlngs regarding the Prelimln(\ry plan Md
sobsequent development of. the Property.
2. 434 Agrees to be bound by the tatms of anO to assume the
obli9ations under that certain Settlement Agreement by and
betweQn Florida Land company and the CITY, a copy of which ir.

development which abuts the proposed Trotwood Doulevard

In t.he event that nei ther option is selected by tha CI'l'y or a
p~rtial conneotlon Is required pursuant to Ite~ (1) above, and

the Right of Ways or other property dedicated to the CITt on the

3. The parties agree that Parngraph l(b) of the Settlement

(100) ac~e5 in the easterly quadrant of the Property for conser-
vntion purposes has been satisfied by that certain Conservation
EasemQnt in favor Ot the State of floridn, Department of EnvIron-
mental Regulation, reoorded February 9, 1982 in Official Records
Book 1377, Page 713, Public Records of SeminOle County, Florida.
4. ~ne partl~s agree that paragraph l(b) of the Settlement
Agreement regarding the dedication of approximately Eorty (40}
acres of the Property for effluent discharge has been satlsfied.
