AGREEMENT

Restroom Facility
It is intended that payment for all work done under the Contract Documents, including the furnishing of all
labor, equipment and materials, and the performing of all operations in connection with the construction of the
restroom facility and the septic system will be made under the following Lump Sum Bid.
The CONTRACTOR agrees to perform all of the WORK described in the CONTRACT DOCUMENTS and comply
with the terms therein for the BASE BID total lump sum price of 559,557.00.
The Owner reserves the right to alter the Plans, extend or shorten the improvement, add such incidental work
as may be necessary, and increase or decrease the work to be performed to accord with such changes,
including deductions or additions to the scope of work outlined in the Contract Documents. Changes in the
work shall not be considered as a waiver of any conditions of the Contract nor invalidate any provisions thereof.
Changes resulting in changes in the scope of quantities of Work or time or other conditions of work will be
basis for consideration of a Change Order which is to be negotiated and executed before proceeding with the
work. Work which has not been authorized by a written Change Order will not be subsequently considered
for additional payment.
The CONTRACTOR will commence the work required by the Contract Documents within 10 days after the date
of the NOTICE TO PROCEED and will complete the same within 120 calendar days unless the period for
completion is extended otherwise by the Contract Documents.
As provided for in the General Conditions, it is expressly understood that actual damages will be sustained by
the OWNER upon the CONTRACTOR's failure to complete construction within the time stipulated. Should the
CONTRACTOR fail to complete the construction in the stipulated time period, the OWNER shall be entitled to
recover from the CONTRACTOR, the sum of one hundred dollars ($100.00) for each calendar day the work
remains uncompleted after the stipulated construction period; which amount is hereby agreed upon as a
measure of the liquidated damages that the OWNER will sustain by reason of any such failure of the
CONTRACTOR as stated before; further, it is understood and agreed that said sum is not considered in any
sense to be a penalty.
The Contractor shall take no advantage of any apparent error or omission in the Plans, Specifications or
Contract Documents and the Engineer shall be permitted to make such corrections and interpretations as may
be deemed necessary for the fulfillment of the intent of the Contract Documents. The undersigned agrees that
his bid as stipulated herein shall be valid for a period of sixty 160) days from the date of this bid opening. The
proposal guaranty of the three lowest bidders shall be held for a maximum of 60 days or until an award of the
contract is made if awarded sooner. CONTRACTOR acknowledges receipt of addendas issued as follows:

Progress payments will be made in an amount equal to 90°~ of the value of Work completed, less, in each case,
the aggregate of payments previously made. This Agreement shall be binding upon all parties hereto and their
respective heirs, executors, administrators, successors, and assigns.

between the Owner and the Contractor for the construction of the proposed facilities. The Owner reserves the
right to reject any or all bids on the project.
