I am pleased to advise you that the City of Altamonte Springs recently concluded franchise negotiations with Time Warner. The franchise requires Time Warner to provide one operative television channel that is available to all subscribers within the City that is designated as a Government/Educational access channel. Such channel may be shared with local governments of other franchise areas served by the system for carriage of governmental and public access programming. Sincerely, C--'~...' 11 ~. ~ (~c Russel E. Such facilities are within the franchise area of the Grantee; b. Such facility is contiguous to any main lateral cable system of a Grantee; and c. The connections are specifically requested by the city. (4) Government channel. a. The Grantee shall provide the city, without charge, one operative television channel over the system. The channel shall be available to all subscribers within the City, except as may otherwise occur due to normal cable system design and/or changes in City boundaries. Such channel shall be designated as a government/educational access channel and shall be shared, to the extent that such shared use continues to meet ihe City's community needs and interests, with the local governments of other franchise areas served by the system for the carriage of governmental and educational access programmmg. b. At the request of the City, the cable system shall be interconnected with other franchised cable systems within the City so as to enable each system to carry and cablecast the educational and governmental access programming of other systems, provided that the operators of the other cable systems agree and are willing to share the costs of such inter-connection on an equitable basis and that the costs to the Grantee are reasonable in light of the benefits to the Grantee and its customers. (5) Monitoring prohibited Except to the extent otherwise authorized by law, no monitoring of a terminal connected to the cable system shall be permitted without the written authorization of the person to be monitored; provided that this subsection does not prohibit maintenance and testing procedures designed to ensure compliance with technical standards, or to detect unauthorized reception of signal. (6) The Grantee shall provide and maintain "general" standby power for each headend. "Battery" standby power for its system shall also be available to provide for up to two (2) hours of continuous operation of the system. (7) The Grantee shall incorporate into its cable system the capability for the City in times of emergency in coordination with County emergency services to override the audio portion of all channels simultaneously to the extent consistent with Federal law. The Grantee shall designate a channel (it may be the governmental programming and access channel) which will be used for emergency broadcasts of both audio and video. The Grantee shall also be responsible for ensuring that compliance with the federal requirements regarding emergency alert systems is maintained throughout the term of the Franchise.
