HomeMy WebLinkAboutResolution 99- Re: Seminole Television Council RESOLUTION 99- A RESOLUTION OF THE , FLORIDA, OFFICIALLY JOINING THE SEMINOLE TELEVISION COUNCIL, PROVIDING FOR CONFLICTS AND AN EFFECTIVE DATE. WHEREAS, on August 31, 1998, Seminole County and Time Wamer Communications entered into an Agreement relating to the provision of a local government/education access channel (Channel) by TWC as required under Section 55.61, Seminole County Code; and WHEREAS, pursuant to both Section 5 of said Agreement and Section 55.61(a) (1) of the Seminole County Code, the allocation and use of the Channel provided by TWC is to be determined by the Seminole County Board of County Commissioners; and WHEREAS, pursuant to Section 6 of said Agreement, the County agreed to provide each municipality within Seminole County, Florida, the Seminole County Community College, and the Seminole County School District the opportunity to participate in and provide programming for the Channel, with each governmental entity being responsible for its own programming, and costs associated therewith; and WHEREAS, the County has developed Operating Policies, Operating Procedures, and Production Standards for the Channel which include a provision for the submittal of programs for airing by eligible organizations that are appropriate and conform to technical and production standards; and WHEREAS, the Seminole Television Council has the Seminole County School District and the following cites as members: Casselberry, Lake Mary, Oviedo, Sanford, Winter Springs; and WHEREAS, the Seminole Television Council would assist in the programming, and management of local government and public educational cable television programming for Seminole County; and WHEREAS, the Board of County Commissioners of Seminole County strongly supports and encourages the efforts of the municipalities, School Board, and Community College in pooling their resources in order to achieve savings in the production of government and educational programming; and Resolution 99- Page 2 WHERES, the County believes that the allocation of a portion of the time available on the County's Channel to the Seminole Television Council subject to the County's Operating Policies, Operating Procedures, and Production Standards would provide the best method of implementing Section 6 of the Agreement between the County and TWC; and WHEREAS, the desires to join the Seminole Television Council and participate in providing programming on the local government/education access channel of Time Warner Communications as required under Section 55.61 ofthe Seminole County code; NOW, THEREFORE, BE IT RESOLVED; THAT: BY THE SECTION I: The Seminole Television Council. approves JOInIng the SECTION II: The will be responsible for all programming costs associated with any programming that it wishes to show on the County's local government/education access channel. SECTION III. The shall determine the content ofthe City's programming in its allotted time, except as restricted by state and/or federal law, on the County's government/education assess channel. SECTION IV. The shall have one (1) vote on the Seminole Television Council, which shall be cast by its representative who must be present at any meeting of the Seminole Television Council to vote. SECTION V. The acknowledges that Seminole County will allocate a portion of the programming time available on the County's government/education channel to the Seminole Television Council which in turn will allocate a portion of the programming time to its' members. SECTION VI. The acknowledges that Seminole Television Council is subject to the County's Operating Policies, Operating Procedures and Production Standards relative to the County's government/education channel. SECTION VII. The is authorized to sign any enabling interlocal agreement consistent with this resolution. Resolution 99- Page 3 SECTION VIII. All other resolutions or parts of resolutions in conflict herewith are hereby rejected. SECTION IX. This resolution shall become effective immediately upon adoption.
